Former Vice President Mike Pence's chief of staff cast doubt on Mark Meadows’ assertion Monday that he was acting in his official capacity in his efforts to try to overturn Georgia’s 2020 election.


Marc Short, during an appearance on CNN’s “The Situation Room with Wolf Blitzer,” shot holes in the claims Meadows was making that are considered pivotal in his effort to move his Fulton County indictment to federal court.

Short said that although the argument his counterpart in the Oval Office made that Meadows was acting “at the behest” of the former president may have merit, the argument that he was acting in an official capacity in connection with the Georgia allegations falls flat.

"I’m not sure that the job description for Donald Trump’s chief of staff ever probably fit into the normal chief of staff’s role. But I think that it's probably true that Mark was acting at the behest of the president, and I think he does deserve the benefit of the doubt there as far as what he's doing," Short said.


“But I do think one challenge for him is to say this is all my official capacity. If that was true, then why was the circumventing all the White House counsel's advice? Why wasn’t Pat Cipollone involved? ... Why wasn't DOJ involved?" he continued.

“Instead, Mark recruited outside lawyers [to] whom he wanted to listen," Short explained. "And so I think that undercuts the notion that ‘this was all part of my federal responsibility.’ Come back and counsel from the people hired into your office to serve the White House in that role.”




Short said the efforts to overturn Georgia’s election were misguided.

“I think the actions that were taken wrong I don't think there's evidence that there was fraud or that the election was stolen and so to call on Roethlisberger to 11,000 votes, I think is gonna be a pretty challenging defense for them,” he closed.

Donald Trump "stands alone in American history for his alleged crimes" related to trying to overturn his loss in the 2020 presidential election, special counsel Jack Smith's office said in a court filing Monday.
"No other president has engaged in conspiracy and obstruction to overturn valid election results and illegitimately retain power," Smith's office said in the filing.


In it, Smith formally opposed bids by Trump's lawyers to dismiss his four-count federal election interference indictment in U.S. District Court in Washington, D.C.

Smith's prosecutors said in the filing that Trump's motions asking Judge Tanya Chutkan to toss the indictment cites past court cases that actually "undermine his arguments rather than support them," and "rely on distortions and misrepresentation."

"The defendant also claims that he could not have known his actions were criminal because, in the past, others who have questioned, challenged, or protested election results were not prosecuted," the special counsel wrote.

"But the defendant stands alone in American history for his alleged crimes."

In a separate filing Monday, Smith's office opposed Trump's motion seeking to strike so-called inflammatory allegations related to the Jan. 6, 2021, Capitol riot by a mob of his supporters from his indictment.


The riot occurred after weeks of false claims by Trump that President Joe Biden had won the 2020 election as a result of widespread ballot fraud.

The other filing alleged that Trump "has promoted and extolled the events of that day. While the violent attack was ongoing, the defendant told rioters that they were 'very special' and that 'we love you.' "

"In the years since, he has championed rioters as 'great patriots; and proclaimed January 6 'a beautiful day," the filing said.

"The Court should recognize the defendant's motion for what it is: a meritless effort to evade the indictment's clear allegations that the defendant is responsible for the events at the Capitol on January 6," prosecutors wrote.

Trump, who is the leading contender for the 2024 Republican presidential nomination, has pleaded not guilty in the case, which is set to go to trial in late March.

Buck’s answer:

Everybody who thinks that the election was stolen or talks about the election being stolen is lying to America and that’s everyone that is making that argument. Everyone who makes the argument that January 6 was an unguided tour of the Capitol is lying to America. Everyone who says that the prisoners who are being prosecuted right now for their involvement in January 6, that they are somehow political prisoners or that they didn’t commit crimes, those folks are lying to America. As a Republican Party, if we’re going to offer good solid policy answers to the real challenges we face in America, we’ve got to get past the lies and we’ve got to have credibility with the American public. And I think we can do that, but we have to move forward.

Brennan noted that Buck supported Johnson’s House Speaker last month even though he’s a 2020 election denier. Buck stood by his support, acknowledging that he worked with Johnson when they tried to legally dispute the election results.
However, Buck also said, “What’s wrong is to try to stop a legal function, a legislative function like counting the votes in an election, as happened on January 6.” When Brennan asked if Johnson needs to be “more clear” on the subject, Buck answered “I hope he becomes more clear. I hope all of my Republican colleagues become more clear and recognize the fact that Joe Biden is an existential threat to this country. We need to defeat him, and we do that with someone who’s not lying to the country.”

MADISON, Wis. — Ten Wisconsin Republicans who posed as fake electors for former President Donald Trump have settled a lawsuit and admitted their actions were part of an attempt to overturn the 2020 presidential election results, attorneys who filed the case announced Wednesday.

The lawsuit was filed against the fake electors by Democratic electors for President Joe Biden, which sought $2.4 million in damages. The fake electors said in a statement Wednesday that they met in the Wisconsin State Capitol to sign paperwork falsely claiming to be electors to be "in compliance with requests from the Trump campaign and Republican Party of Wisconsin."

As part of the settlement, the fake electors acknowledged that Biden won the state, withdrew their filings and agreed not to serve as presidential electors in the future or participate in the transmission of such documents again, among other terms. The defendants are also no longer facing paying damages.

"The Elector Defendants took the foregoing action because they were told that it was necessary to preserve their electoral votes in the event a court challenge may later change the outcome of the election in Wisconsin. That document was then used as part of an attempt to improperly overturn the 2020 presidential election results," the fake electors wrote.

10 Republicans filled out this paperwork certifying that Donald Trump

"We oppose any attempt to undermine the public’s faith in the ultimate results of the 2020 presidential election. We hereby withdraw the documents we executed on December 14, 2020, and request that they be disregarded by the public and all entities to which they were submitted."

The settlement marks the first time Trump electors have withdrawn their filings claiming that the former president had won in seven battleground states during the 2020 election. Nevada on Wednesday became the third state to criminally charge fake electors, following Georgia and Michigan.

Attorneys named in the lawsuit
The 10 Republicans will no longer be part of the lawsuit because of the settlement, according to Jeff Mandell, who represents the plaintiffs in the case. But the attorneys named in the lawsuit, Jim Troupis and Kenneth Chesebro, will continue to stand trial in September, Mandell said.

Chesebro pleaded guilty to a felony charge of conspiracy to commit filing false documents after being charged with participating in efforts to overturn Trump’s loss in Georgia. Chesebro was also charged alongside Trump and 17 others with violating the state’s anti-racketeering law.

"Americans believe in democracy and the idea that the people choose their leaders through elections. The defendants’ actions violated those bedrock principles," Mandell said in a statement. "This settlement agreement provides one piece of that accountability and helps ensure that a similar effort to subvert our democracy will never happen again."

The Wisconsin lawsuit cites a memo Chesebro sent to Troupis, who oversaw Trump's post-election legal strategy in Wisconsin, in November 2020 detailing the elector plan.

'Electors were tricked'
The settlement also comes as Trump is the leading candidate in the 2024 Republican primary for president. Trump has been indicted over his actions leading up to the Jan. 6, 2021 insurrection − charges that focus heavily on the fake elector strategy.

Hitt said Wednesday he won't support Trump in 2024. Hitt also said he has been cooperating with the state Department of Justice since December 2022.

"The Wisconsin electors were tricked and misled into participating in what became the alternate elector scheme and would have never taken any actions had we known that there were ulterior reasons beyond preserving an ongoing legal strategy," Hitt said. "I will not be supporting Trump in 2024. We have serious problems facing this country and we need a President who will not repeat 2020 and will focus on tackling those difficult issues."

The filings from the fake electors in Wisconsin and elsewhere helped Trump and his allies argue the results were in dispute as they tried to prevent Congress from finalizing them.

Republicans in Arizona, Georgia, Michigan, and Nevada also signed documents purporting to be electors. Republicans in New Mexico and Pennsylvania filled out paperwork saying they should be considered electors if courts found Trump had won their states.

Michigan’s attorney general filed felony charges in July against 16 Republicans who acted as fake electors for Trump, accusing them of submitting false certificates that confirmed they were legitimate electors despite Biden’s victory in the state.
