The news was reported on Friday by Maggie Haberman of the New York Times, who said she uncovered it during research for a book on Trump due out in October.

On 5 January, Haberman wrote, Pence’s chief of staff, Marc Short, did not know how his boss’s security might be threatened if Trump turned on him. But Trump and advisers had been formulating a plan under which Pence would stop certification of electoral college results in Trump’s defeat by Joe Biden.

Under pressure which the Times said included withholding funding for the vice-president’s transition out of power, Pence considered the plan before concluding he did not have the authority to reject electoral college results.

When the mob attacked the Capitol on 6 January, rioters were heard to chant “Hang Mike Pence” while a gallows was set up outside.

The Times recently reported that two witnesses who spoke to the January 6 committee said Trump told Mark Meadows, his own chief of staff, “something to the effect of, maybe Mr Pence should be hung”.

Trump told another reporter and author, Jon Karl, his supporters “were very angry” with Pence and that it was just “common sense” to be so, because Pence was not helping overturn Trump’s election defeat.

The Times said it was not clear what Tim Giebels, the head of Pence’s Secret Service detail, did with the warning from Short.

The next day, with the Capitol under attack, Pence’s protectors rushed him from the Senate chamber to an underground parking bay. Multiple accounts have said the vice-president refused to leave the building.

According to Short, Pence said: “I’m not going to let the free world see us fleeing the Capitol, and I’m staying.”

Authors of books on the Trump presidency have been widely criticised for withholding news until publication. Haberman was known for having strong sources in the Trump White House, and was filmed taking calls from Trump himself.

She published her nugget about Trump’s threat to Pence in the run-up to public hearings due to be staged by the House committee investigating the events of 6 January 2021.

Pence and the Secret Service did not comment on the new Times report.

A former ally of Rudy Giuliani, Donald's Trump's ex-attorney, reportedly concocted a scheme to have former Vice President Mike Pence relinquish his role in the January 6 vote-counting ceremony to a top Senate Republican, who was then expected to overturn the election by blocking the electoral votes in several battleground states.

The plan, CBS News reports, was outlined in a December 2020 email sent by attorney Kenneth Chesebro to Trump and Giuliani. In it, Chesebro details that Pence would hand over the baton to Sen. Chuck Grassley, R-Iowa, the Senate president pro tempore, by claiming that he has a "conflict of interest" as a result of being on the 2020 ballot. In theory, the plan would have effectively had Pence ignore the procedures outlined by the Electoral Count Act of 1878, which required that the vice president open all the electoral votes and hand them to Congress to be officially counted. Once Grassley takes over, the memo detailed, he "opens the two envelopes from Arizona, and announces that he cannot and will not, at least as of that date, count any electoral college votes from Arizona because there are two slates of votes."

Giuliani cancels appearance with Jan. 6 committee
At one point in his email, Chesebro also reviewed possible rulings by the Supreme Court that would come as a result of the swapping out Arizona's electors with partisan officials.

"It doesn't seem fanciful to think that Trump and Pence would end up winning the vote after some legislatures appoint electors," Chesebro noted.

Ultimately, Pence did not end up going along with Trump's plan and instead opted to count the ballots himself, resulting in Trump's official defeat.

Back in March, Chesebro was subpoenaed by the January 6 select committee for supporting a plan to replace U.S. electors with a slate of MAGA-friendly ones in states that the president lost. House investigators have said that he "participated in attempts to disrupt or delay the certification of the results of the 2020 presidential election."

According to court filings, Chesebro's email was sent to John Eastman, the author of a different election coup scheme, just days before the insurrection unfolded. In March, Eastman was found by a federal judge to have "more likely than not" committed multiple felonies in his six-point plan to overturn the election.

"This may have been the first time members of President Trump's team transformed a legal interpretation of the Electoral Count Act into a day-by-day plan of action. The draft memo pushed a strategy that knowingly violated the Electoral Count Act, and Dr. Eastman's later memos closely track its analysis and proposal," Judge David O. Carter wrote of Chesebro's email. "The memo is both intimately related to and clearly advanced the plan to obstruct the Joint Session of Congress on January 6, 2021."

again it was so real to those with the VP that they alerted the SS to a clear and present danger. Never in the history of the USA has this occurred that a VPs people were so worried about a president intending harm or attacking a VP. Again this to me passes all burdens to get a very pit bull special council appointed right away and grand jury seated 2 years ago.

The day before the Capitol attack, Short warned Pence’s lead Secret Service agent that then-President Donald Trump was going to turn against Pence, and, in the Times’ words, that “there could be a security risk to Mr. Pence because of it.”

That warning was one of several indicators listed in the report that Trump was attempting to turn the screws on Pence: Trump reportedly sought to arrange a meeting between Pence and Sidney Powell, the Trump-allied lawyer that falsely alleged a vast conspiracy to rig the election. Some on Pence’s team were suspicious Powell would serve Pence with legal papers, the Times reported.

Separately, Pence reportedly received a memo from the Trump aide and noted football trickshot artist John McEntee with the text, “JEFFERSON USED HIS POSITION AS VP TO WIN.”

But most intriguingly, the Times reported that Trump’s chief of staff, Mark Meadows, informed Short that Trump was withholding transition funds for Pence that could be used to establish a post-White House office. That development, per the report, “left the Pence team on high alert about the pressure campaign.”

The funds were ultimately approved, the Times reported — soon after Jan. 6.

As we’ve discussed, this led to an ongoing court fight over Congress’ ability to subpoena the attorney’s records, which Eastman has claimed are protected by attorney-client privilege. The committee has pushed back, arguing that communications between attorneys and clients are not protected if they’re discussing committing crimes.

In late March, U.S. District Court Judge David Carter agreed, concluding, “Based on the evidence, the Court finds it more likely than not that President Trump corruptly attempted to obstruct the joint session of Congress on January 6, 2021.”

This was an extraordinary moment — there’s no modern precedent for a sitting federal court to conclude that a former president likely committed a felony — and it led to some additional important disclosures. That said, the court ruling applied to a set of communications from a specific time period, and the larger legal fight over other Eastman emails is ongoing.

Last night, Carter issued his latest ruling in this case, and as a Washington Post analysis explained, in brings the bigger picture into even sharper focus.

[Carter] ruled that more of Trump lawyer John Eastman’s documents and emails must be turned over to the committee, because they pertain to the likely crime and thus they are not privileged. And in doing so, Carter offered a notable account of the plot. He said the “plan to disrupt the Joint Session” of Congress on Jan. 6 — the crime he says was likely committed — “was fully formed and actionable as early as December 7, 2020.”


Well, that’s new.

To be sure, we knew that Trump, Eastman, and their allies plotted against a joint session of Congress, when lawmakers were tasked with certifying the results of the 2020 election. What these new revelations suggest is that the plot was “fully formed” much earlier than previously known.

Indeed, by all accounts, Eastman formally joined the Republican’s campaign legal team on Dec. 6, 2020. Evidently, the attorney brought a coup plan with him, since the scheme was “actionable” one day later.


Jan. 6 committee sets the stage for a historic presentation
According to a Politico report, the latest revelations also included an email from an unidentified attorney encouraging the then-president’s team not to pursue a case in court related to the Jan. 6 session of Congress — because an adverse ruling could “tank the January 6 strategy.”

As attorney Luppe Luppen (known on Twitter as “southpaw”) summarized this morning, “[A]ccording to a federal judge, the then-sitting president likely engaged in a monthlong criminal conspiracy to disrupt the joint session of Congress. The conspirators considered and jettisoned the idea of testing the legality of their plans in court. That same president then went out and fomented the mob violence that disrupted the joint session of Congress.”

Well, sure, when you put it that way, it sounds bad.

Of course, all of this comes in advance of the Jan. 6 committee’s public hearings, which begin in earnest tomorrow night. The fact that these Eastman materials are reaching Capitol Hill for review before the prime-time event is no doubt good news for investigators.

Trump made that comment around 1:10 p.m., after “law enforcement officials headed to the Republican National Committee headquarters because a pipe bomb had been found there” at 12:45 p.m.

Woodruff Swan notes that at that same time “Trump supporters clashed with police and began to move onto restricted grounds around the Capitol.”

Engel’s testimony adds important context as to what Trump was thinking and planning that day. The additional information raises the prospect that Trump wanted to pressure his Vice President, Mike Pence, in person to refuse to certify the 2020 presidential election results.

The Capitol hearings began yesterday and they were quite interesting. Through extensive interviews and reviewing evidence, the committee is making a strong case against Trump and the many Republicans who still back him. There is clear evidence that many of Trump’s advisors told him he lost the election (Barr told Trump the claims of fraud were “bullshit”), but he kept up the story, invited his backers to D.C. to “stop the steal,” emboldened the Proud Boys and Oath Keepers, and then directed them to march on the Capitol.

The video footage was striking both literally and figuratively. Trump’s supporters were not “tourists,” but armed and violent cultists. Trump loved it and did nothing to try to stop it. Aware of the rioters' chants to hang Mike Pence, the president responded with this sentiment, "Maybe our supporters have the right idea. Mike Pence deserves it."

The committee chairman said in an interview that there is evidence that Trump’s team had direct contact with the militias prior to the event. Trump’s team had a 7 part plan to steal the election, and the Committee is going to prove this. The Committee chair also said the everything they will present is 100% true and provable. It seems to be that there will a good case to charge Trump with sedition.

Liz Cheney, a rare Republican with honor, made strong statements. The two that I liked the best were “"tonight, I say this to my Republican colleagues who are defending the indefensible: There will come a day when Donald Trump is gone, but your dishonor will remain" and “President Trump summoned the mob, assembled the mob and lit the flame of this attack.”

In a curious New York Times report earlier this week, the Capitol Police seemed to conclude that the GOP lawmaker’s tour was innocuous. There’s still reason to believe otherwise. NBC News reported this morning:

The Jan. 6 Committee on Wednesday released new footage of a man outside the Capitol on Jan. 6 making violent verbal threats against top Democratic lawmakers — who the day before had been taken on a tour of House office buildings by Rep. Barry Loudermilk, R-Ga.

What started as a mysterious accusation from members reluctant to go into details has come into much sharper focus.

It’s no longer a point of contention that Loudermilk conducted a tour the day before the attack, which was itself odd: Due to Covid restrictions, there were no tours at the time.

According to congressional investigators, the Georgia Republican’s group nevertheless stayed for several hours, and surveillance footage shows them visiting House office buildings and the entrances to tunnels leading to the U.S. Capitol.

More specifically, according to the Jan. 6 committee, Loudermilk’s guests “photographed and recorded areas of the complex not typically of interest to tourists, including hallways, staircases, and security checkpoints.”

From a personal perspective, I can say that I’ve spent hundreds of hours on Capitol Hill, and certain sights are always popular with tourists. I don’t think I’ve ever seen anyone taking pictures of hallways, staircases, or security checkpoints — and if I did see such a thing, it would’ve seemed quite weird.

One of the images released by the committee this morning showed a man taking a picture of a staircase in the Longworth House Office Building that leads to a tunnel that goes to the Capitol building itself. Democratic Rep. Brendan Boyle of Pennsylvania published a tweet this morning noting that this is the same staircase he takes to his office — and in his eight years as a congressman, he’s “never seen a tourist taking a picture of it.”

Making matters worse is the fact that one of Loudermilk’s guests threatened Democratic lawmakers a day later. From the NBC News report:

The video includes pictures the Jan. 6 committee says the attendees of Loudermilk’s tour took, including the outside of Nadler’s office and what appears to be an office directory for the Judiciary Committee, with the photos of Democratic lawmakers. “There is no escape Pelosi, Schumer, Nadler — we’re coming for you,” the man says in the video.


Why the Capitol Police concluded that Loudermilk’s tour was entirely benign is unclear.

Remember, a House GOP aide later told The Hill four months ago, “There were no tours, no large groups, no one with MAGA hats on.”

But there was a tour, the group wasn’t small, some wore red caps, and they seemed interested in photographing locations that Capitol visitors are generally uninterested in.

This morning, Loudermilk, who’s clearly changed his story, issued another statement denying any wrongdoing, while the bipartisan select committee investigating the attack once again urged the Georgia Republican to cooperate with the investigation. Watch this space.
