Judge's Ruling on Special Master for Donald Trump Ripped by Legal Experts

Quote:
Multiple legal experts have expressed dismay with the appointment of a special master to review documents discovered by federal authorities last month in Donald Trump's Mar-a-Lago home.

The surprise Labor Day order issued by Trump-appointed U.S. District Judge Aileen Cannon appeases Trump's attorneys, who initially made the request due to "presumptively privileged" documents that perhaps involve presidential communication with advisers. The decision not only allows an independent expert to review some 13,000 records but also halts the ongoing criminal investigation by the Department of Justice.

Attorney and former acting Solicitor General Neal Katyal said Monday that "any of my first year law students would have written a better opinion."

NEWSWEEK NEWSLETTER SIGN-UP >
He particularly took umbrage with Cannon's reference to the potential "reputational" harm of Trump in relation to the investigation, arguing that every criminal defendant suffers reputational harm and yet not every case requires a special master.

"Judge [Cannon] enjoins the entire investigation because some of the material might be subject to Executive Privilege," Katyal said as part of a series of tweets. "But Executive Priv isn't some post-presidential privilege that allows Presidents to keep documents after they leave office. At most, it simply means these are Executive documents that must be returned to the archives. It doesn't in any way shape or form mean they can't be used in a criminal prosecution about stolen docs."

Cannon's order finding that "some tiny percentage of materials might be privileged," Katyal said, pauses the investigation entirely.

"That's a bazooka when one needs at most a scalpel," he added.

Attorney Seth Abramson echoed Katyal's thoughts, writing on Twitter that "nearly every criminal defendant in the history of criminal defendants everywhere in the world" thought they were being treated unfairly at some point.

"Trump appointee Aileen Cannon declared—and not just implicitly, but, horrifyingly, *explicitly*—that Donald Trump's reputation simply *matters* more than yours or mine, as do his property rights," Abramson tweeted. "And they matter more because he is a powerful man."

Norm Ornstein of the American Enterprise Institute alleged in a tweet that Cannon "engaged herself in obstruction of justice" simply by taking the case—which was originally overseen by a magistrate judge who presides in a jurisdiction near Mar-a-Lago, closer than Cannon herself.

Legal scholar Jonathan Turley disagreed, calling the special master appointment "the right decision." He has stated that Attorney General Merrick Garland missed multiple opportunities to "earn the public trust" regarding the document search and investigation, including opting for a search warrant rather than a second subpoena.

"The Justice Department dramatically over-played its hand by claiming that the appointment would threaten national security or that there was no legal basis for such an appointment," Turley tweeted. "Those were the same claims used to oppose any release of any information in the redacted affidavit—only to be forced to release such a document without compromising national security."

Trump was active on his Truth Social account on Monday, calling the FBI and DOJ "totally corrupt" and saying that "many sinister and evil outside sources" are reducing the United States "to being a third-world nation."

“Unfit for the bench”: Experts accuse Trump judge of “obstruction of justice” over Mar-a-Lago ruling

Quote:
Political observers on Monday said U.S. District Court Judge Aileen Cannon "engaged herself in obstruction of justice" by ruling that the U.S. Department of Justice must halt its review of materials seized at former President Donald Trump's Florida estate, Mar-a-Lago.

Cannon, who was appointed by the former Republican president and confirmed after he lost the 2020 election, ruled that Trump "faces an unquantifiable potential harm by way of improper disclosure of sensitive information to the public" if the review of the materials, which included documents marked "confidential" and "top secret" continues.

Political scientist Norman Ornstein noted that lawyers for Trump hand-picked Cannon to oversee the case.

Cannon "has violated her oath and is unfit for the bench," he tweeted, adding that her ruling is "a clear-cut impeachable offense."

Slate journalist Mark Joseph Stern said he had been assured that "no judge would take Trump's absurd filing seriously" after the former president sued the DOJ over the FBI raid which was sparked by the department's finding that Trump had taken classified documents from the White House when his term ended in January 2021.

"The problem, of course, is that Cannon is not a real judge, but a Trump judge, and one of the most corrupt of the bunch," said Stern.

Cannon ruled that a "special master" should be appointed to review the materials seized by the FBI and said the federal government should be "temporarily enjoined" from examining the documents further.

The Justice Department now has until September 9 to propose a list of special master candidates. It was unclear Monday whether the Biden administration would appeal Cannon's ruling.

Former President Donald Trump was in possession of the nuclear secrets of an unidentified country when FBI agents raided his home last month, according to a report.

The Washington Post reported a document seized by the bureau on Aug. 8 was so sensitive, many inside the intelligence community do not have the clearance to access it.

Outrage builds over new report Trump stashed top secret nuclear documents at Mar-a-Lago

Quote:
Former President Donald Trump was slammed Wednesday after a new report claimed he had super top secret documents describing a foreign country’s nuclear capacities stashed at his Florida resort home.

Former Defense Secretary William Cohen, a lifelong Republican, led a chorus of outrage, calling the new report fresh evidence that Trump poses a “clear and present threat to democracy.”

Ex-federal prosecutor Renato Mariotti called the mere presence of the document at Trump’s home evidence of a grave crime.

“It is among our nation’s most closely held secrets,” Mariotti said on Twitter. “What possible justification is there for taking and holding this document in a country club?”

Donald Trump Rages as DOJ Appeals Special Master Decision

Quote:
Donald Trump is fuming as the Department of Justice (DOJ) seeks to block an independent arbiter from overseeing documents seized from his residence, deriding the government's move as a massive waste of time and money.

Former president Donald Trump speaks to supporters at a rally to support local candidates at the Mohegan Sun Arena on September 03, 2022 in Wilkes-Barre, Pennsylvania. Trump on Thursday lashed out at the Department of Justice appealing a court ruling to appoint a special master to oversee documents seized by law enforcement at his home.

Trump on Thursday lashed out at the Department of Justice appealing a court ruling to appoint a special master to oversee documents seized by law enforcement at his home.

The former president on Thursday lashed out in a post to his Truth Social network after the DOJ signaled it would appeal a judge's approval of a special master that has said it will slow its investigation of Trump's alleged hoarding of classified documents. The appeal is the latest in the legal wrangling following the FBI's court-approved search of Trump's Mar-a-Lago residence in August.

"So now the FBI & Biden Department of 'Justice' leakers are going to spend Millions of Dollars, & vast amounts of Time & Energy, to appeal the Order on the 'Raid of Mar-a-Lago Document Hoax,' by a brilliant and courageous Judge whose words of wisdom rang true throughout our Nation, instead of fighting the record setting corruption and crime that is taking place right before their very eyes," Trump said in the post.

In a follow-up post, Trump rehashed his long-running grievances with federal law enforcement agencies, accusing them of leaking information, lying and planting "fake evidence."

The DOJ on Thursday filed a notice that it would appeal U.S. District Court Judge Aileen Cannon's decision earlier this week approving a request from Trump's lawyers to appoint a special master. Trump's lawyers argued the special master was needed to sort out personal materials or documents covered by attorney-client or executive privilege that were mixed in with other documents seized from his Florida home.

Michael Cohen suggests Trump will blackmail the DOJ by threatening to reveal secrets to foreign powers

Quote:
Appearing on MSNBC on Sunday morning, former Donald Trump lawyer Michael Cohen said he wouldn't put it past the former president to threaten to reveal secrets to foreign powers if the Department of Justice tries to indict him.

Speaking with fill-in host Michael Steele on "The Sunday Show," Cohen was asked why he thinks Trump hauled classified documents to Mar-a-Lago with him after he lost the 2020 presidential election.

"Based on everything you know about him, why do you think he wanted to keep those top secret documents at Mar-a-Lago," host Steele asked.

"He's gonna use it as a get out of jail free card," Cohen immediately shot back. "It's a way to extort America; to turn around to say if you put me in jail, if you go after me -- he'll even say his children -- I will have my loyal supporters who you do not know who has copies of information that may have been, and again this is my conjecture, that I would take those documents, I will release them to Iran, to China, to North Korea, to Russia.

"You want to take me down, I'll take the whole country down," he added.

"Remember, and I've said this with you 1000 times, Mike, Donald Trump doesn't care about this country," he continued. "He doesn't care about anyone or anything other than himself."

Trump lawyer may be stripped of 'attorney-client privilege' over Mar-a-Lago obstruction: legal expert

Quote:
Buried in a profile of Donald Trump attorney Christian Bobb, one legal expert suggested she and the former president may find that the legal protections afforded by the attorney-client privilege may be stripped away from them due to accusations she may have assisted in obstructing the DOJ.

Detailing Bobb's quick rise from OAN host to currently being part of a team of lawyers defending the former president's attempt to hoard highly sensitive government documents at his Mar-a-Lago resort, Business Insider's Sophia Ankel wrote that Bobb's signing of documents that all materials had been handed back to the government when they had not, has put her in the DOJ's crosshairs.

According to the report, "In a legal filing last month, the DOJ alleged that Bobb and Evan Corcoran, another Trump lawyer, misled prosecutors by saying they had handed over all classified documents from Mar-a-Lago."

Adding that "Experts said the filing could build a legal case that Bobb and Corcoran obstructed the government's investigation, and urged both lawyers to get lawyers of their own," Ankel spoke with attorney and national security expert Bradley Moss who claimed she has major legal problems in her future.

"Bobb certainly, at a minimum, is a material-fact witness in the context of the government's inquiry into possible obstruction and efforts to conceal the records located at Mar-a-Lago," he explained.

"It is not out of the realm of possibility that the government ... will at least seek a court order compelling her to testify before the grand jury, citing the crime-fraud exception to attorney-client privilege.," he elaborated.

As for Bobb's continuing appearances on Fox News defending Trump's on his Mar-a-Lago document problems, Moss added, "She should stay off of TV at this point, as [she] is only making the situation worse."

Did Trump Transfer Documents to Bedminster? Ex-FBI Official Floats Theory

Strzok's comments come a month after the FBI raided Trump's Mar-a-Lago resort residence where they found confidential and classified documents. Attorney General Merrick Garland confirmed last month that he personally approved the decision to seek a search warrant for the raid.

On Twitter on Saturday, Strzok posted images of video footage reported in early May by the Daily Mail showing Trump boarding a private jet in Florida en route to his Bedminster golf course.

In the footage, staff members can be seen loading boxes onto the plane. Strzok posted a zoomed in image of staffers holding the boxes next to an image taken by the Department of Justice (DOJ) during the raid. The DOJ photo shows a box containing what appear to be magazine covers, next to documents that are labeled "Top Secret."

"Better check Bedminster..." Strzok tweeted. "On May 6, [the National Archives and Records Administration] emails Trump to say material is missing and may be at [Mar-a-Lago]. On May 9, Trump gets on a private plane from Palm Beach to Bedminster. On video, several boxes are seen loaded onto the plane."

"Type/brand of box look familiar?" he asked while posting the images of the boxes being loaded onto the plane, as well as a zoomed in version of the box in the DOJ photo.

"Good example of harm to nat sec from waiting to use [Mar-a-Lago] classified docs: ID and interview these folks, compare their fingerprints w/ those on seized docs/empty folders, build [probable cause] for other warrants," Strzok wrote in another tweet.

Strzok's comments come after prosecutors said this week that Trump may not have returned all of the classified documents that are missing. Reuters reported Friday that prosecutors say it may present a national security risk that merits investigation.

Strzok was fired from the FBI after text messages from 2016 were released revealing anti-Trump remarks between himself and FBI lawyer Lisa Page. He frequently criticizes the former president, and published a book in 2020 titled Compromised: Counterintelligence and the Threat of Donald J. Trump.

Newsweek has reached out to Trump's press office for comment.

In an interview in August, Strzok said foreign intelligence services in countries, including Russia and China have "absolutely" tried to gain access to Mar-a-Lago.

"What's especially concerning right now is some of the information that's coming out about the absolute lack of any sort of control, or memorialization of who had access to Mar-a-Lago at any given time—particularly in the context of the fact that it appears that classified documents were strewn all over the facility," he told MSNBC.

This week, a judge dismissed a lawsuit Trump had filed against 2016 presidential candidate Hillary Clinton, alleging that Clinton and others accused him of colluding with Russia prior to the 2016 presidential election. Strzok was a defendant in the lawsuit.

"Trump's lawsuit against me and many others just dismissed," Strzok tweeted Friday.
