Next meeting of the California State Lands Commission is Thursday, April 26, 2022, at 1:00 p.m. It is remote, so easy to speak up. Or, you can send an email in advance. Easy.

Public comment is permitted at the beginning.

Why the State Lands Commission (SLC)? Treasure Island was man made with "fill." As such, it was land "owned" by the State of California, and held in " public trust" and managed by the SLC in a fiduciary capacity for all of us. In 2014, the SLC agreed to transfer ownership of TI to the Treasure Island Development Authority (TIDA) in a Trust Exchange Agreement. The Agreement transferred the trust/fiduciary obligations to maintain public access to TIDA, expressly including recreational access to the shoreline.

The CCSF (through its agencies including TIDA or the Treasure Island Mobility Management Agency) either charging a toll or eliminating access to N.E. cove to the Bay altogether [as seen in the latest TIDA iteration] is a breach of the 2014 Trust Exchange Agreement.

Basically, CCSF through its agencies in an enormous breach of its fiduciary duties is seeking to avoid the quid pro quo/consideration for receiving title to our lands which are to be held in trust for us to use for recreational purposes. Ask the SLC to enforce the Agreement.

Update. The Treasure Island Mobility Management Agency (TIMMA), the city "agency" staffed by the San Francisco County Transportation Agency (SFCTA), is holding an "outreach" on TI at the Ship Shape Community Center, 850 Avenue I., today at 5:30 p.m.,regarding the toll and affordability for low income. This is an in-person only meeting.

They will likely have nothing about fulfilling the City's fiduciary obligations to make the shore line accessible for recreation consistent with the City's TIDA/State Land Commission's 2014 settlement, or the Bay Conservation Development Commission's 2015 permit obtained in exchange for the commitment to honor the 2006 Bay Plan which provides for parking and access at the n.e. corner of TI for boardsailors. Yet, it will be the first public appearance of supervisor Matt Dorsey who has been appointed to fill Matt Haney's seat as the chair person of TIMMA and Haney's seat on the CCSF's Board of Supervisors.

So might be an opportunity to show up and inform Supervisor Dorsey the following:
1. AB 981, the legislation that enables the CCSF, through TIMMA, to charge a toll does NOT require a toll be implemented. Rather, it is discretionary and is contrary to what the scoundrel Haney asserted as a toll being "mandatory due to the law of AB981." Dorsey probably inherited Haney's staff and is being fed this untrue position by the SFCTA.
2. AB981 does, though, require any toll to (1) be a benefit to the driver's paying the toll...which the SFCTA day 1 plan fails since loading and unloading of your gear on buses and a ferry and then having it secured while you are sailing is not contemplated. The Day 1 plan does not even have their shuttle go to the N.E. ramp. Your are expected to take either a non-existent bus from the east bay or park at the Ferry Building and ride the ferry to the island and hop on their on-island shuttle with all your gear and then carry your gear an extra mile to the launch. (2) AB981 also requires the toll shall not interfere with public access to the recreation on the waterfront/shoreline, and (3) since their "transportation plan" fails to work for board sailors, we are simply being asked to subsidize commuters.
3. The original Final Environmental Impact Report (FEIR) stated visitors to TI would not be charged a toll. SFCTA "amended" it by claiming it was too difficult to implement a system where visitors were not charged but residents would be charged. Yet, now they are doing just that by claiming low income and current residents [until they are kicked off the island] will not be charged a toll.
4. The same FEIR shows that recreational users travel in "off-peak" hours and do not contribute to the "congestion" which is being created by the new 20,000 residents to inhabit the new 8,000 residences. We do not benefit from a reduction in congestion during commute hours sought by the toll.
5. $$$ - Although obscure in their budget discussions, the toll is to pay for the ferry capital charges and operating expenses. Yet, we are already paying an increased bridge toll (currently $7.00) of which ~$335M is for supporting the ferry. So, particularly for east bay residents that want to use their state lands (TI is state land b/c it was created by fill), we are already paying for the ferry and a congestion fee.
