Another GOP voter caught casting a ballot for a dead relative

In the wake of Donald Trump's defeat last fall, Republicans launched a desperate search for illegally cast ballots to help justify the GOP's conspiracy theories. But as regular readers know, despite all the hysterical rhetoric, only a handful of legitimate allegations have been raised -- and some of the most notable examples involve Republicans casting illegal ballots on behalf of dead relatives.

Take Pennsylvania's Robert Richard Lynn, for example. The Times Leader in Wilkes-Barre reported yesterday:

A man from Forty Fort said he used "poor judgement" and regrets using his deceased mother's name on an application for an absentee ballot for the 2020 presidential election. Robert Richard Lynn, 68, of Center Street, pleaded guilty to a third-degree misdemeanor charge of violations relating to absentee or mail-in ballots during a court proceeding before Luzerne County Judge Michael T. Vough on Monday.

The recent pattern is pretty amazing. Revisiting our earlier coverage, we learned in May, for example, about Pennsylvania's Bruce Bartman, who cast an absentee ballot in support of Trump for his mother -- who died in 2008. Bartman pleaded guilty to unlawful voting, conceded he "listened to too much propaganda," and was sentenced to five years' probation.

About a month later, Edward Snodgrass, a local Republican official in Ohio, admitted to forging his dead father's signature on an absentee ballot and then voting again as himself. NBC News noted at the time that Snodgrass struck a deal with prosecutors and was sentenced to three days in jail and a $500 fine.

This new example is notable in part because of the amount of effort the Republican voter in Pennsylvania invested in his scheme. This guy used a typewriter to complete an absentee ballot application -- pretending to be his deceased mother, Lynn claimed to be "visiting great grand kids" around the time of the election -- before signing the dead woman's name.

It wasn't long before election officials flagged the ballot, when a database showed that the voter in question died six years ago.

The defendant faced up to two years behind bars. He instead received a sentence of six months' probation.

As we've discussed, there are a handful of ways to look at incidents like these. My first thought is of Crystal Mason, who cast a provisional ballot in the 2016 while on supervised release for a federal conviction. She didn't know she was ineligible to vote, and her ballot was never counted, but Mason -- a Black woman -- was convicted of illegal voting and sentenced to five years in prison.

It's hard not to notice that White men like Robert Richard Lynn, Edward Snodgrass, and Bruce Bartman received vastly more lenient sentences, despite the fact that they knowingly hatched schemes to cast illegal ballots on behalf of dead relatives.

“I’ve looked at it objectively,” Peters said of supposed issues in election data during her speech at MyPillow CEO Mike Lindell’s “Cyber Symposium” this month. “There’s some discrepancies there that I cannot deny, and I tell people, ‘I cannot unsee some of these things.’ If I’m going to be honest with the people of Mesa County and Colorado and all of you, I cannot unsee some of these things.”


But at home in Mesa County, some current and former officials have a different recollection of Peters’ tenure overseeing elections.

During Peters’ first year as clerk, in 2019, her office was blamed for leaving more than 570 uncounted ballots in a box, long past an election. Less than a year later, one of her office’s drop boxes leaked ballots, sending some floating in the summer breeze. Now Peters has gone underground, reportedly hiding in a safe house provided by Lindell, after she allegedly participated in a breach of Mesa County voting machine data this year. That data soon wound up on conspiracy websites, making Peters a folk hero among the MAGA set and the subject of an FBI investigation.

Peters (who did not return requests for comment) took office in 2019, after her predecessor, Sheila Reiner, reached her term limit. What followed was an unusually bombastic tenure in a typically low-drama role.

While overseeing the November 2019 general election, Peters’ office forgot to count 574 ballots, instead leaving them unattended in a drop box outside her office for months. That slip-up coincided with a rush of departures from Peters’ office. In December 2019, nearly 20 of Peters’ 32-person staff had departed, the Grand Junction Daily Sentinel reported at the time. More staff quit days after the missing ballots were discovered, in late February 2020, bringing the departure count over two dozen.

The Colorado Secretary of State’s Office told Peters to get her act together.

another state does a random recount at the request of millionaire ultra partisan right winger Mr. Pillow. It turns out again there were less votes when the recount was done for trump. The Biden votes were correct.

Seems that from every recount the dems are being cheated.

The attorney leading a partisan review of Wisconsin's 2020 election acknowledged this week that he doesn't understand how elections are supposed to be run. The admission by former state Supreme Court Justice Michael Gableman comes as he subpoenas mayors and election officials.

"Most people, myself included, do not have a comprehensive understanding or even any understanding of how elections work," Gableman conceded on Tuesday.

Oh. So what we have here is a situation in which the Republican conspiracy theorist responsible for reviewing Wisconsin's elections, by his own admission, is completely clueless about how elections work.

Arizona Senate's election review records again ruled public

PHOENIX (AP) — A judge has rejected the Republican-controlled Arizona Senate’s contention that it can withhold a raft of communications between its leaders and private contractors they hired to conduct an unprecedented review of the 2020 election results in the state’s most populous county.

The ruling released Thursday evening is the latest in a series of losses for the Senate stemming from its efforts to keep secret records showing how the review was conducted. A watchdog group called American Oversight had sued to compel their release and repeatedly won. The Arizona Republic newspaper has a separate lawsuit seeking records from the election review.

The Senate has already released tens of thousands of records after court rulings in the American Oversight case found they were covered by the state's public records law. It was trying to shield more than 1,000 other texts and emails.

American Oversight said it is fighting for the public's right to know how the partisan audit was funded and how Cyber Ninjas and other private contractors hired by the Senate conducted the review.

Maricopa County Superior Court Judge Michael Kemp’s ruling said the Senate’s position that the records were covered by legislative privilege was flat wrong. He said that privilege is intended to protect debate about pending legislation and in this case there is no proposed legislation.

And he said the Senate waived any privilege when Senate President Karen Fann and other top Republicans made public statements about the “audit.” He also noted that Fann and GOP Sen. Warren Peterson presided over an hours-long hearing last month that “was much more akin to a press conference.” At that hearing, the Senate's contractors presented results of the review that showed President Joe Biden did in fact win Maricopa County while raising questions about procedures.

“Senate Defendants cannot publicly release numerous public statements about the audit, release a comprehensive report about the audit, and then refuse to disclose documents and communications that are central and integral to the findings and conclusions of that report,” Kemp wrote.

Kemp said that he would allow the Senate to advance only narrow exemptions based on confidentiality, privacy or the best interests of the state "if those interests outweigh the public’s right to access those records.”

“From the beginning, the Senate has promised transparency while fighting to block any public scrutiny of its so-called audit process,” Austin Evers, American Oversight's executive director, said in a statement. "The time for full transparency is now. We look forward to further rulings from the court.”

The ruling could be appealed to a higher court. Fann said Friday that she disagreed with the judge's ruling and would meet with the Senate's lawyers to decide what to do now. She said there are legitimate issues of legislative privilege at stake.

“We understand the transparency issue,” Fann said. “But we also believe that he has gotten way over that line."

Kemp set a hearing for early in November to review the progress of the Senate's records release.

The judge said the main question for the public is the basis for the conclusions contained in the report, many of which have been questioned by Maricopa County officials. He said an audit of the results of a presidential and U.S. Senate election “goes to the heart of our democracy” and the public has the right to compare the final report to the underlying documents.

“The public has a right to know the basis for these conclusions and findings and to challenge and scrutinize those findings,” Kemp wrote. “The public has a right to know how the audit was done, who paid for it and how much was paid. The public also has a right to know the identity of any political organizations who financed the audit.”

Last week, another Maricopa County Superior Court judge ordered the Senate to turn over other records it argued were privileged so he could review them in private. The Arizona Republic had good reason to believe that legislative privilege does not apply to at least some of the records, Judge John Hannah wrote in a 13-page ruling.

The Senate launched the review after former President Donald Trump and his backers brought unsubstantiated allegations that he lost in Arizona and other battleground states because of fraud or other election malfeasance.

But the review ended without producing proof to support Trump’s false claims of a stolen election. A hand recount of 2.1 million ballots found that Biden won Maricopa County by 360 more votes than the official results certified last year.

Fann and Senate Republicans plan to advance legislation next year that addresses what they contend are problems with the state's election system.

The partisan review of the Arizona results, which were certified by Republican Gov. Doug Ducey in an election he defended as free and fair, has raised concerns about its effect on public trust in elections. A U.S. House committee took testimony last week from GOP Maricopa County officials, one of whom called the audit “the biggest threat to democracy in my lifetime.”

A Clark County man prominently featured by local and national Republicans as having evidence of voter fraud in the 2020 election has agreed to plead guilty to voting more than once during the same election, after using his deceased wife's ballot to vote a second time. The man, Donald Kirk Hartle, was publicly cited by the Nevada Republican Party last November as evidence of voting irregularities that affected the results of the 2020 election — Hartle, 55, claimed to learn that someone had cast a ballot in the 2020 election for his wife Rosemarie Hartle, who died in 2017.

To appreciate the significance of this case, let's review how we arrived at this point.

Over the course of the last 12 months, the public has learned of a handful of instances in which Donald Trump supporters were caught trying to cast ballots on behalf of dead relatives. In each instance, the Republicans were caught; the fraudulent ballots were not counted; and the cases were referred for prosecution. Several perpetrators have already pleaded guilty.

But the story surrounding Rosemarie Hartle's ballot in Nevada is something else altogether.

In the other documented instances, GOP voters quietly tried to get away with an illegal scheme. When they got caught — cheating is extremely difficult — those who tried and failed to pull off their schemes pleaded for mercy in court.

In Nevada, however, Rosemarie Hartle's ballot became a rallying cry and a lynchpin to a larger partisan strategy. Hartle died of cancer in 2017, but someone nevertheless tried to cast a ballot in her name last fall. Her husband, Donald Kirk Hartle, allowed himself to become a player in the partisan gambit, expressing public outrage that someone had dared to cast a ballot on behalf of his late wife.

He even appeared in the media, describing what transpired as "sickening."

For Republican officials, in Nevada and elsewhere, this was the story they'd been waiting for. Finally, there was proof of some criminal finding a flaw in the system and casting a dead woman's ballot. For much of the right, this wasn't just an instance of voter fraud; this was the instance of voter fraud.

Fox News' Tucker Carlson told his viewers last November, in reference to the Hartle matter, "In moments like this truth really matters more than ever. False allegations of fraud can cause as much damage as the fraud itself.... So we want to be accurate. What we're about to tell you is accurate. It is not a theory. It happened and we can prove it."

He proceeded to highlight the Hartle case, which the host said the "news media" is "hiding" in order to help then-President-elect Joe Biden.

The Fox News anchor was hardly alone. Dinesh D'Souza, a far-right provocateur, published a tweet last November that read, "[Donald Kirk Hartle] was SHOCKED when he found out his wife, who died in 2017, just voted in the 2020 election. Are you really going to tell me voter fraud doesn't exist?" The Nevada Republican Party also seized on the case — and admonished news organizations for not doing the same.

But the entire controversy recently started to unravel when Donald Kirk Hartle was accused of being the one responsible for casting his late wife's ballot. And today, as he pleads guilty, the foundational case for Republican conspiracy theorists will evaporate.

That in turn will leave me with a couple of questions. First, will there be any apologies from those who seized on this case as proof of systemic flaws in our system of elections? I'm guessing the answer is no.

And second, will Donald Kirk Hartle receive a lighter sentence than Texas' Crystal Mason? I'm guessing the answer is yes.
