Weeks after the 2020 presidential election, former Attorney General Bill Barr’s Department of Justice pursued a secret grand jury subpoena seeking to unmask an anonymous Twitter account that parodied Donald Trump-loyalist Rep. Devin Nunes (R-Calif.), according to a bombshell motion unsealed on Monday.

Twitter sought to quash that subpoena against the account @NunesAlt, which had been sealed since Nov. 24, 2020 and hushed up by a gag order, in a motion dated May 10.

“Under the First Amendment, the government cannot compel Twitter to produce information related to the account unless it ‘can show a compelling interest in the sought-after material and a sufficient nexus between the subject matter of the investigation and the information it seek[s],'” Twitter’s lawyers wrote in the 16-page motion.

“While Twitter does not have visibility into the purpose of the subpoena, Twitter has serious concerns whether the government can meet this standard given the context in which it has received the subpoena,” the motion continues.

Twitter catalogued what authorities wanted in an exhibit.


“His efforts to suppress critical speech are as well-publicized as they are unsuccessful,” Twitter’s lawyer John K. Roche, from the D.C. powerhouse firm Perkins Coie, notes in the motion, referring to Nunes. “He recently sued Twitter, attempting to hold it liable for speech by the parody Twitter accounts @DevinCow, @DevinNunesMom, @fireDevinNunes, and @DevinGrapes, and asking the court in that case to order Twitter to disclose information identifying those accounts. Each of these accounts were engaged in anonymous political speech critical of Congressman Nunes. That suit was dismissed against Twitter in June 2020 because Twitter cannot be liable for information originating with a third-party user of its service, but it appears to still be an active lawsuit against the Twitter users @DevinCow and @DevinNunesMom.”

Twitter claimed that history made the company wary of the Justice Department’s subpoena.

“Given Congressman Nunes’s numerous attempts to unmask his anonymous critics on Twitter—described in detail herein—Twitter is concerned that this subpoena is but another mechanism to attack its users’ First Amendment rights,” the motion states. “Recent litigation also alleges that Congressman Nunes may be using the government to unmask his critics.”

In a blithely defiant tweet, the anonymous user behind the @NunesAlt account celebrated the revelations.


The Justice Department did not immediately respond to a request for comment.

In addition to the subpoena, Twitter claims it also received a “gag order” barring them from “disclos[ing] the existence of the subpoena to any other person” except for their attorneys for 90 days because the Justice Department claimed to have “reasonable grounds to believe that such disclosure will result in flight from prosecution, destruction of or tampering with evidence, intimidation of potential witnesses, and serious jeopardy to the investigation.”

“The Gag Order does not describe the basis for this finding, and Twitter has not received any information from the government about the ‘reasonable grounds’ upon which the Gag Order was based,” Twitter added.

Chief U.S. District Judge Beryl A. Howell ordered the filing unsealed on Sunday, and it became public a day later. The judge also ordered the Justice Department to respond by Wednesday, “with the name and contact information of the government attorney redacted,” information that is routinely made public in similar proceedings.

they should have said it was intentional not as they did saying it was not intentional lying.

I say bring those who made the lies go in front of the judge for their lies.

The Trump administration made every effort to include a citizenship question in the 2020 census, though the gambit ultimately failed. Supreme Court Chief Justice John Roberts explained in 2019 that the White House came up short, not because a citizenship question was legally impermissible, but because the administration didn't have a coherent, justifiable reason for their plan.

Making matters worse was the fact that then-Commerce Secretary Wilbur Ross obviously lied about the scheme, as other Trump administration officials struggled to keep their stories straight.

As Government Executive reported, the matter was so significant that the Commerce Department's inspector general's office opened an investigation and concluded that officials, including Ross, "provided false testimony regarding the origins of the proposed citizenship question on the 2020 census."

The Commerce IG launched its probe in 2019, following a request from lawmakers. The investigators did not make their report public, citing Privacy Act concerns, but said in a letter to Senate Majority Leader Chuck Schumer, D-N.Y., and Rep. Carolyn Maloney, D-N.Y., that Ross and other officials played a "substantive role" in proposing the addition of the citizenship question to the census.... Ross twice told Congress the addition of the citizenship question was based solely on a request from the Justice Department, but the IG found Ross "misrepresented the full rationale" behind the decision.

And while it's of interest that the former cabinet secretary lied to Congress, more than once, about the Republican scheme, it's of even greater significance that the inspector general's office presented its findings to the Public Integrity Section of the Justice Department's Criminal Division.

In other words, the agency's independent watchdog department thought the Trump appointees' deceptions might have risen to the level of criminal wrongdoing.

As it turns out, the Justice Department decided not to prosecute, which has proven to be a familiar consequence.

As regular readers may recall, the first example was Ryan Zinke. Corruption allegations involving Donald Trump's scandal-plagued Interior secretary were referred to Justice Department prosecutors, but Trump's DOJ declined to charge the Montana Republican.

Then there was Alex Acosta, Trump's scandal-plagued Labor secretary, who was also referred to Justice Department prosecutors, only to have Trump's DOJ decline to charge the Florida Republican, too.

Robert Wilkie, Trump's controversial VA secretary, was also referred to Justice Department prosecutors, only to have Trump's DOJ choose not to charge him, either.

It was earlier this year when we learned that the Transportation Department's watchdog also asked the Justice Department to criminally investigate former Secretary Elaine Chao late last year over allegations that she misused her office. In keeping with the pattern, Trump's DOJ didn't pursue the matter.

Though the details of the timeline are not yet clear, in the case of Wilbur Ross, it appears it was the Biden administration's Justice Department that declined to prosecute.

The bottom line in striking: Five times a member of Trump's cabinet was referred to the Justice Department for possible prosecution. Five times nothing happened.

Former Trump inaugural committee chair Tom Barrack on Friday was released from federal lockup in California on a $250 million bond ahead of his scheduled arraignment in New York on charges he acted as an agent of the United Arab Emirates and obstructed justice.

As part of the terms of his release, Barrack, 74, is subject to electronic monitoring and will have to foot the bill for his GPS ankle bracelet, Judge Patricia Donahue ordered, signing off on an agreement that had been worked out between the government and Barrack's attorneys.

Barrack, a private equity investor and founder of the investment firm Colony Capital, also had to surrender his passports and is barred from transferring funds overseas, the judge said. He cannot trade any securities without written permission from federal prosecutors and is not allowed to transfer more than $50,000 except for attorneys fees.

He's scheduled to be arraigned in federal court in Brooklyn, New York on Monday. His spokesman said earlier this week that Barrack "is not guilty and will be pleading not guilty.”

Barrack was also charged with obstruction of justice and making multiple false statements to federal law enforcement agents
