"This unprecedented rebuff, from everyone from former vice President Mike Pence to former defense secretary Mark T. Esper to former attorney general William P. Barr to former chief of staff John F. Kelly, speaks to Trump’s manifest flaws and how they are visible to those who know him best," Rubin wrote. "Even more stunning, these former advisers have shared hair-raising observations of Trump’s outbursts, mind-set and personal depravity."

Kelly recalls the former president favorably commenting on Adolf Hitler doing "some good things" and generally admiring dictators, while Esper has revealed that Trump wanted to deploy active-duty troops in Washington, D.C., and suggested shooting protesters with whom he disagreed, and Barr has described him as reckless, a narcissist and a "troubled man."

"Though these Republicans regrettably have not had the wherewithal to endorse President Biden, the only candidate capable of preventing the manifestly unfit former president from returning to power," Rubin wrote, "they can still serve their country by preventing their old boss from regaining power — power, this time, without the guardrails they provided in his first term."

Just as mental health professionals have a duty to warn authorities or a potential victim if one of their patients appears to pose a threat to others, those who have taken an oath of office also have the same obligation to warn the country of the threat Trump poses to national security and democratic institutions.

"Their observations, not well known to most voters, would be powerful and frightening because they go to the heart of his capacity to govern in a democracy," Rubin wrote.

"Trump no doubt will continue to rage against his former advisers, despite his boast that he hired only the 'best people,'" she added. "But a unified and consistent effort from a substantial number of former high-ranking officials to educate the American people, especially 'soft' Republicans who continue to hold these former Trump aides in high esteem, could act as a powerful counterweight to the false equivalence that afflicts too much campaign coverage."

In a post on X, Democratic Representative Sean Casten of Illinois said Trump’s financial difficulties make him a “massive national security risk” as he seeks a second term in the White House.

He wrote: “The presumptive GOP nominee for President is desperate for $464M (and counting) which he cannot personally access. That fact alone makes him a massive national security risk; any foreign adversary seeking to buy a President knows the price.”

Trump has consistently denied any wrongdoing in the civil fraud case and maintains that, if anything, his assets were undervalued.

A distinguished group of retired four-star generals and admirals from the U.S. military have argued in a brief filed in the U.S. Supreme Court on Monday that Donald Trump’s claims of absolute “presidential immunity” from criminal prosecution tied to Jan. 6 is an “assault” on the “foundational commitments” underpinning democracy and if his argument is allowed to succeed before them later this month, it threatens “to subvert the careful balance between the executive and legislative branches struck in the Constitution.”

The 38-page amicus brief features 19 authors, all of them decorated retired admirals, generals or secretaries from branches of the U.S. Army, Navy and Air Force respectively. On April 25, the high court is poised to hear Trump’s question of immunity against prosecution for his alleged criminal conspiracy to subvert the results of the 2020 election. and according to the brief, these are arguments that should be approached with extreme caution.

“Petitioner’s theory of presidential immunity threatens to subvert the careful balance between the executive and legislative branches struck in the Constitution. For example, if emboldened by absolute immunity, the President might unsuccessfully seek authorization from Congress to undertake a certain action and then attempt to have the military carry out that action even though Congress rejected it. Moreover, our Constitution directs the people’s elected representatives in Congress to enact criminal laws that the executive is tasked with enforcing; allowing the President to violate those laws with impunity fundamentally distorts this constitutional allocation of powers,” they wrote.

The Constitution subjects the armed forces of the United States to civilian control and the rule of law. These limits on the military are bedrock features of our democracy and are deeply rooted in our nation’s history. From the Founding to the present day, a steadfast commitment to these principles has successfully guided us through two world wars and numerous other conflicts; provided the stability needed for our democratic republic to flourish; and ensured that the military has the capacity to defend our nation by being trained and ready to fight and win its wars. Petitioner’s theory of presidential immunity from criminal prosecution is an assault on these foundational commitments.

As Law&Crime has previously reported, Trump contends that the president cannot function, as a matter of fact, without total immunity from the threat of prosecution.

It would “incapacitate every future president with de facto blackmail and extortion while in office and condemn him to years of post-office trauma at the hands of political opponents,” Trump’s legal team told the Supreme Court in February.



But this is not so, according to the brief filed on Monday. The career military officials say that if Trump’s version of immunity were to be accepted, it would “severely undermine the commander-in-chief’s legal and moral authority to lead the military forces” because it would for once and all signal that “they but not he must obey the rule of law.”

“Under this theory, the President could, with impunity, direct his national security appointees to, in turn, direct members of the military to execute plainly unlawful orders, placing those in the chain of command in an untenable position and irreparably harming the trust fundamental to civil-military relations,” they wrote.

Calling Trump’s view “profoundly ahistorical,” the career military officials wrote that “absence of absolute immunity is something that has been correctly assumed since the founding” of the nation and that contrary to his point, no president before him has been damaged or inhibited as he suggests even as the threat of facing criminal prosecution hung over their heads all the same.


Some of the authors include Ray Mabus, who served as the 75th Secretary of the Navy from 2009 to 2017. Mabus was the longest to serve as leader of the Navy and Marine Corps since World War I. Other filers include retired General Michael Hayden of the Air Force. A four-star general, Hayden served as Director of the Central Intelligence Agency and the National Security Agency as well as Commander of the Air Intelligence Agency. On the very last day of its term, the Supreme Court will hear question that Trump has used to gird every defense he has made while he faces felony indictments in multiple venues.

The case involving his alleged conspiracy around Jan. 6 has been waylaid for nearly a year — he was indicted last August. Trump’s team has pushed repeatedly to see the criminal trial in Washington, D.C., extended beyond the November election. Whether he will get his wish is uncertain but U.S. District Judge Tanya Chutkan has indicated a willingness to keep as tight a schedule as possible and special counsel Jack Smith has expressed the same.


The order stated only that the court would resolve the question of “whether and if so to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office[.]”

At the center of Trump’s defense to the charges in Washington, D.C., is something the retired military officials argue would “harm our national security and undermine our role as the international standard-bearer of democracy.”

“Presidential transitions are times of significant national security risk. Leaders in the outgoing administration must prepare their successors to take the reins, and any complications in this handoff can diminish the successors’ preparedness to handle national security threats,” they wrote.

The U.S. Circuit Court of Appeals ruled against Trump’s stark bid for “absolute immunity” as president already. The judges resoundingly rejected his claims that under certain circumstances, a former president could even get away with murdering his political rivals.

Cobb served as Trump's special counsel for two years. He was joined in signing the brief by Patrick J. Fitzgerald, who served as U.S. Attorney for the Northern District of Illinois in the George W. The nation's highest court will hear oral arguments on the presidential immunity debate April 25 as part of Trump's aim to dismiss Smith's 2020 election obstruction case into the former president, where the Republican has pleaded not guilty to four federal charges.
The brief's preparation was led by Seth Waxman, a former U.S. Solicitor General. Conservative anti-Trump lawyer and legal analyst George Conway also signed the "friends of the court" brief.

The key arguments of the amicus brief are: The Constitution does not endow former presidents with immunity from criminal prosecution. And, in addition, even if former presidents had some limited immunity against criminal prosecution for certain official acts, it could not conceivably reach the acts alleged here.

The brief states that Trump's immunity claims are "inconsistent with our Constitution and would subvert the bedrock principle that no person is above the law."

It also urges the Supreme Court to affirm the decision of the Court of Appeals for the D.C. Circuit which upheld the ruling by Judge Tanya Chutkan, who is overseeing the federal trial into the former president's alleged criminal attempts to overturn the 2020 election results and the events that led up to the January 6, 2021, riot at the U.S. Capitol.

Newsweek reached out to Trump's campaign via email, and to Cobb through his LinkedIn page, Monday afternoon for comment.

Fred Wertheimer, President of Democracy 21 Education Fund, also helped prepare the brief.

"There is no basis for the Court to take a different approach in this case," Wertheimer said in a Democracy 21 press release. "The Court should, as they did in the Colorado case last month, issue its opinion no more than 25 days after the April 25 oral argument – by May 20. For the Court to wait to issue its decision until June, would delay the trial and seriously jeopardize the ability of citizens to know before they voted whether Trump is found guilty in this criminal case."

Trump faces 91 felony charges across four criminal cases. The former president has pleaded not guilty to all charges against him and has frequently accused the state and federal investigations of being politically motivated "witch hunts" that aim to hinder his chances of winning the 2024 election.

The federal trial into Trump's alleged criminal attempt to overturn the 2020 election results and the events that led up to the January 6 attack could be further delayed for several months pending the Supreme Court's ruling on the immunity argument.

A number of legal experts have suggested the Supreme Court will ultimately reject Trump's argument that he can still cite absolute immunity for conduct committed in the White House, despite no longer being in office.
