Trump Seeks To Bar Testimony Of Other Accusers In Rape Trial

Former President Donald Trump’s lawyers moved late Thursday to block testimony from previous accusers in the sexual battery lawsuit filed against him by writer E. Jean Carroll.

The attorneys are also asking Judge Lewis Kaplan, of the U.S. District Court in Manhattan, to ban the infamous “Access Hollywood” tape that was publicly released in 2016 shortly before Trump won the presidential election.


He boasted on the 2005 tape that he liked to “grab” women by the “pussy.” Trump, who hosted the “Apprentice” TV reality show, bragged he could get away with it because he was “a star.”

His attorneys argued in a filing that the tape was “irrelevant and highly prejudicial.” They claimed the previous accusations against Trump also weren’t relevant to Carroll’s allegation that Trump raped her in a dressing room at the Bergdorf Goodman store in Manhattan in the 1990s.

Among those who also accused Trump are former business executive Jessica Leeds, who said that he groped her in 1979 when he sat next to her on a plane.

“He was with his hands grabbing me, trying to kiss me, grabbing my breasts, pulling me towards him, pulling himself on to me,” Leeds testified in her deposition for the case last October.



Another accuser, Natasha Stoynoff, said in her deposition that Trump shoved her against a wall and began kissing her at his Mar-a-Lago estate in 2005 when she was researching a story about him for People magazine.

Carroll’s attorneys argued that both women’s stories are relevant because they demonstrate Trump’s “modus operandi of forcing himself on non-consenting women.”

Trump has denied he assaulted the other women or Carroll.

Carroll also sued Trump for defamation in 2019 after he angrily denied her sexual battery allegation in a White House interview. He claimed that Carroll was not his “type” and that she was just out to get publicity.

Late last year, Carroll filed the suit against Trump under the recently passed Adult Survivors Act, which temporarily lifts the statute of limitations for a year on civil claims over alleged sexual offenses.

Trump’s lawyers have denied Carroll’s rape allegation. As for defamation, they have argued that whatever Trump said as president was protected from any legal action. But Trump repeated some of the same attacks against Carroll on his Truth Social platform early this year. He called Carroll’s accusation a “complete con job” and a “hoax and a lie.”



Whatever protections he may have had as president presumably vanished when he repeated the attacks as a private citizen.

Trump’s publicly released deposition on the latest suit was startlingly vicious. “I know nothing about this nut job,” he said of Carroll, and he threatened to sue her, according to the transcript.

As for Carroll not being his “type,” Trump mistakenly identified a photo of the writer as his second ex-wife, Marla Maples, during a deposition.

Kaplan hasn’t yet ruled on the request to block information. The trial is set to begin in April.

(The Hill) – A federal judge ruled on Friday that E. Jean Carroll can use the infamous "Access Hollywood" tape and the testimony of two other women who have accused former President Trump of sexual assault as evidence at trial in her defamation case.

District Judge Lewis Kaplan rejected a request from Trump's team to disallow the tape and the testimony from the two women, Natasha Stoynoff and Jessica Leeds, who separately accused the former president of assaulting them in late 1970s and early 2000s.

The disagreement centered on a rule that allows for evidence that a defendant "committed any other sexual assault" when a civil case is "based on a party's alleged sexual assault."

Carroll has accused Trump of raping her in a department store in the mid-1990s and of later defaming her by claiming that she lied about the incident. The alleged defamation includes a 2019 interview with The Hill in which Trump said Carroll was "totally lying" and "not my type."

Because Carroll has two pending cases against the former president - one solely for defamation and another for battery and defamation - Trump argued that the case that pertains only to defamation is not based on an alleged sexual assault and does not fall under the evidence rule.

However, Kaplan rejected Trump’s reasoning, noting that "proof of sexual assault is an essential element of Ms. Carroll's defamation claim given the nature of the alleged defamation."

The "Access Hollywood" tape from 2005, which resurfaced ahead of the 2016 presidential election, captured Trump boasting about his apparently unsolicited advances on women.

"When you're a star, they let you do it. You can do anything," he said, adding, "Grab them by the [expletive]. You can do anything."

Kaplan noted that the tape is relevant in Carroll's case given that "a jury reasonably could find, even from the ‘Access Hollywood' tape alone, that Mr. Trump admitted in the ‘Access Hollywood' tape that he in fact has had contact with women's genitalia in the past without their consent, or that he has attempted to do so."

In the case of the two other accusers, Trump argued that their allegations are "vastly different" from Carroll's, a claim that Kaplan dismissed as "not very persuasive."

"The alleged acts are far more similar than different in the important aspects," the judge noted.

Leeds accused Trump of sexually assaulting her on a flight from Texas to New York in 1979, while Stoynoff claimed that the former president assaulted her at Mar-a-Lago in 2005 during a visit to conduct an interview for People magazine.

Trump has denied both allegations.

Judge Lewis issued a scathing ruling in the defamation suit Carroll filed in 2019 after Trump accused her of lying about being raped by him. The question was whether the case should proceed with an anonymous jury. In deciding the issue, Judge Lewis referenced Trump’s recent rant about his allegedly impending arrest, a well as other examples of incitement and “violent rhetoric.”

From the ruling:

Mr. Trump’s quite recent reaction to what he perceived as an imminent threat of indictment by a grand jury sitting virtually next door to this Court was to encourage “protest” and to urge people to “take our country back.”‘ That reaction reportedly has been perceived by some as incitement to violence.’

And it bears mention that Mr. Trump repeatedly has attacked courts, judges, various law enforcement officials and other public officials, and even individual jurors in other matters.’

In addition to Mr. Trump’s past words and actions together with perceptions of them by many people, it is highly relevant that this case already has been the subject of widespread media coverage. Even the most modest developments have attracted a good deal of attention.

That coverage is likely only to increase once the trial is imminent or in process. In these circumstances, this Court is obliged to consider the likely effect on jurors of the matters just described, similar events in the relatively recent past, and the likely future course of events, including the inevitable extensive media coverage. And it cannot properly ignore the significant risk that jurors selected to serve in this case will be affected by concern that they could be targeted for unwanted media attention, outside pressure, and retaliation and harassment from persons unhappy with any verdict that might be returned.


Lewis warned that without an anonymous jury, there would be a “strong likelihood” of “influence attempts, and/or of harassment or worse of jurors by supporters of Mr. Trump”:

Indeed, Mr. Trump himself has made critical statements on social media regarding the grand jury foreperson in Atlanta, Georgia, and the jury foreperson in the Roger Stone criminal case. And this properly may be viewed in the context of Mr. Trump’s many statements regarding individual judges, the judiciary in general, and other public officials, as well as what reports have characterized as “violent rhetoric” by Mr. Trump including before his presidency.

The judge noted that neither party to the suit objected to an anonymous jury, and only media outlets did object. But he was unpersuaded by their argument, which he said omitted the “overriding principle” of the precedent they cited:

On the basis of the unprecedented circumstances in which this trial will take place, including the extensive pretrial publicity and a very strong risk that jurors will fear harassment, unwanted invasions of their privacy, and retaliation by virtue of the matters referred to above, the Court finds that there is strong reason to believe that the jury needs the protection prescribed below. No less restrictive alternative has even been suggested. The presumption of access to juror names is overcome by this risk.

Trump has consistently and relentlessly attacked E. Jean Carroll since she went public with her allegations.

Donald Trump is flying increasingly close to the sun when speaking about writer E. Jean Carroll on the campaign trail — and a lawyer for the ex-Elle columnist suggested Monday he could get burned again.

“Ninety-one million based on false accusations made about me by a woman that I knew nothing about, didn’t know, never heard of, I know nothing about her,” he continued.

“She wrote a book, she said things,” Trump added. “And when I denied it, I said, ‘It’s so crazy. It’s false.’ I get sued for defamation. That’s where it starts.
