Brazilian Authorities Will Revive Fraud Case Against George Santos

When Representative-elect George Santos takes his seat in Congress on Tuesday, he will do so under the shadow of active investigations by federal and local prosecutors into potential criminal activity during his two congressional campaigns.

But an older criminal case may be more pressing: Brazilian law enforcement authorities intend to revive fraud charges against Mr. Santos, and will seek his formal response, prosecutors said on Monday.

The matter, which stemmed from an incident in 2008 regarding a stolen checkbook, had been suspended for the better part of a decade because the police were unable to locate him.

A spokeswoman for the Rio de Janeiro prosecutor’s office said that with Mr. Santos’s whereabouts identified, a formal request will be made to the U.S. Justice Department to notify him of the charges, a necessary step after which the case will proceed with or without him.


The criminal case in Brazil was first disclosed in a New York Times investigation that uncovered broad discrepancies in his résumé and questions about his financial dealings.

Just a month before his 20th birthday, Mr. Santos entered a small clothing store in the Brazilian city of Niterói outside Rio de Janeiro. He spent nearly $700 using a stolen checkbook and a false name, court records show.

Mr. Santos admitted the fraud to the shop owner in August 2009, writing on Orkut, a popular social media website in Brazil, “I know I screwed up, but I want to pay.” In 2010, he and his mother told the police that he had stolen the checkbook of a man his mother used to work for, and used it to make fraudulent purchases.

A judge approved the charge in September 2011 and ordered Mr. Santos to respond to the case. But by October, he was already in the United States and working at Dish Network in College Point, Queens, company records show.

Despite his earlier confessions, Mr. Santos has recently denied any criminal involvement, telling The New York Post, “I am not a criminal here — not here or in Brazil or any jurisdiction in the world.”

Joe Murray, a lawyer for Mr. Santos, said on Monday, “I am in the process of engaging local counsel to address this alleged complaint against my client.”

Mr. Santos’s swearing-in on Tuesday as the representative of New York’s Third Congressional District was already set to take place amid a cloud of scrutiny.

Last week, irregularities in Mr. Santos’s campaign spending emerged, including $40,000 on flights and payments for rent that are linked to an address where Mr. Santos is reported to be staying, a possible violation of the ban on using campaign funds for personal expenses.

Mr. Santos also lied about graduating from college and had misled voters about having worked for Citigroup and Goldman Sachs. He also acknowledged owing thousands of dollars in unpaid rent, and withdrew his claim that he owned multiple properties.

The next step for Brazilian prosecutors is to file a petition when the courts reopen at the end of the week requesting that Mr. Santos respond to the charges against him. A judge would then share the request, called a rogatory letter, with the federal Justice Ministry in Brazil, which would share it with the U.S. Department of Justice. Neither the Justice Department nor Brazilian authorities can compel Mr. Santos to respond at this point. But Mr. Santos must be officially notified in order for the case to proceed.

A criminal conviction, even for a felony, is not on its own an act that would disqualify a congressional member from holding office. The last time a member of Congress was removed from office for breaking the law was in 2002, when James A. Traficant Jr. was removed from the House after his conviction on felony racketeering and corruption charges.

If Mr. Santos does not present a defense in the Brazilian case, he will be tried in absentia. If found guilty, Mr. Santos could receive up to five years in prison, plus a fine.

But according to The Daily Beast, on Santos’ official U.S. House website (paid for with your tax dollars,) the “perpetual liar” claims he “voted ‘nay’ on the House omnibus bill, which would be difficult given it was Dec. 23 and Santos had yet to take office.”

Congressman(-elect) Ritchie Torres (D-NY) tweeted a screenshot of the false claim from Santos’ website.

The New Republic, first to report Santos’ fake “vote,” calls it a “bold-faced lie.”


“It’s not impossible for there to be clerical errors while keeping track of members’ votes,” The New Republic concedes. “However, that is slightly less likely when the error is published on the particular website of a specific member of Congress. It is unclear why a newly elected member of Congress would choose to do this. Then again, you could say the same with regard to most of the brazen lies Santos has already told.”

NCRM located an archived copy of Santos’ website via the Internet Archive, and that omnibus bill is not the only one he appears to have claimed he voted on. Santos’ website claimed he made another five roll call votes on four bills, at least as early as December 22.

Included among Santos’ “brazen lies,” as TNR calls them, is a post on the same Santos website that claims he had been sworn in on Tuesday, which is false since no one was sworn in on Tuesday, nor – at least yet, on Wednesday.

There are local, federal and international investigations into Santos’s alleged fraud.

Sam Miele, who worked for Santos' campaign, is said to have impersonated Dan Meyer, who has served as McCarthy's chief of staff since 2019, in phone calls to donors during the 2020 and 2022 election cycles, people familiar with the matter said, per CNBC.

The Washington Times was the first to report the claim of impersonation last month, when it said that the fundraiser allegedly posing as Meyer also used a fake email address to send follow-up emails to donors.

A source, a New York GOP operative who did not disclose their name, told The Washington Times that McCarthy's aides first became aware of the allegations after a GOP donor flagged contact from the supposed McCarthy aide as "unusual" in August 2021.

According to CNBC, Santos' campaign paid Miele almost $50,000 for fundraising during the embattled lawmaker's failed 2020 run for Congress. Miele was also paid over $42,000 during the 2022 cycle, Federal Election Commission data shows, per CNBC.

Well, this kind of hypocrisy goes back even further than Saint Ronny.

The New York Republican accepted campaign contributions from Rocco Oppedisano, who was expelled from the U.S. in January 2019 and then arrested for piloting a yacht loaded with undocumented migrants and $200,000 in cash toward Florida, and the donations are almost certainly illegal, reported The Daily Beast.

Santos appointed Oppedisano's brother Joseph and nice Tina, who operate the upscale Queens restaurant Il Bacco, to his “Small Businesses for Santos Coalition,” and his two campaigns spent $25,443.64 at the eatery since first running for Congress in 2020, and his most recent campaign reported owing Il Bacco $18,773.54 for its 2022 Election Night party.

Legal experts noted that more than a half dozen of those expenses marked "Food and Beverage" were suspiciously reported at $199.99, which exactly one penny below the threshold that would have required them to hold onto receipts of the transaction.

"You can’t structure transfers of money in a way to intentionally get around the law,” said Jordan Libowitz, communications director for Citizens for Responsibility and Ethics in Washington. “If someone was trying to structure and kind of lazy about it… this is kind of what it would look like.”

Oppedisano himself gave $500 to the Santos campaign on Sept. 22, 2022, despite having his permanent resident status taken away after a 2009 bust for firearms, pills and cocaine in at homes belonging to Joseph Oppedisano, who told The Daily Beast he had introduced his brother to the congressman but insisted he could not recall whether he encouraged the donation.

However, FEC records show Joseph Oppedisano and another brother had donated the same amount on the same day, just days after Santos established his small-business coalition.

“There are some things on which there is no gray area on with the FEC, and one of them is donations from foreign nationals,” Libowitz said.

Santos-connected political committees also spent thousands of dollars at Il Bacco, including $4,473.07 spent on meals and fundraising expenses by Rise NY PAC, which is run by his campaign treasurer and his sister, and $2,405.31 from the account of a failed state Senate candidate who worked with a firm, Redstone Strategies, with links to the congressman.

The Washington Post, citing court documents and video footage from Zoom meetings, reported that Santos’ connection to Andrew Intrater expanded beyond the maximum $5,800 Federal Election Commission filings show Intrater and his wife each contributed to the congressman’s main campaign committee and the tens of thousands more since 2020 to committees linked to him.

As Santos faces investigations over alleged campaign finance violations, the Post argues it’s uncovered evidence of the congressman and Intrater’s business relationship as Santos first entered politics in 2020.

Intrater is the cousin of Russian tycoon and Kremlin insider Viktor Vekselberg, who was sanctioned by the U.S. government for supporting Russian President Vladimir Putin’s invasion of Ukraine.

Though Intrater is a U.S. citizen, his investment firm, Columbus Nova, took on Vekselberg’s conglomerate, Renova Group, as its largest client in 2018 when the oligarch with an estimated net worth of $6 billion was first designated by the Treasury Department for his role in the Russian energy sector.

The Post pointed to a Security Exchange Commission complaint against Harbor City Capital, where Santos worked for more than a year. The Post says Intrater put hundreds of thousands of dollars into Harbor City, which has been accused by regulators of being a Ponzi scheme in Florida federal court.

Intrater’s dealings with Cohen, whom he hired as a fixer to identify potential business deals, were also investigated by special counsel Robert Mueller’s while looking into alleged Russian interference in the 2016 presidential election. Neither Intrater nor Vekselberg were accused of any wrongdoing in the Mueller probe.

Unrelated to Intrater, Cohen pleaded guilty to lying to Congress, bank fraud and campaign finance violations before turning his back on former President Donald Trump in testimony to the House Oversight Committee in 2019.

In a 2020 Zoom meeting, Santos claimed Intrater’s firm, Columbus Nova, was a "client" of his during a discussion about the difficulty experienced by investors in a luxury residential real estate tower located at 432 Park Avenue in Manhattan. It’s not clear if Intrater’s firm was involved in the project, but Santos remarked how it was "unjustified" that Columbus Nova made news over the Russian probe.

Harbor City obtained a $625,000 deposit from FEA Innovations, a company registered in Mississippi that lists Intrater as its lone officer, The Post reported, citing an exhibit included in the SEC complaint. In 2021, Santos founded his own consulting business called Devolder, LLC.

A recent complaint filed against Santos by two Democratic congressmen with the House Ethics Committee says he contributed $705,000 to his own campaign. The complaint accused Santos of a "straw donor" scheme, suggesting he could have disguised contributions from unknown individuals or corporations as his own income from Devolder. He did not report income from Harbor City, despite the congressman having been paid by that firm as recently as April 2021, according to the Post.

Fox News Digital reached out to Santos’ communications director for comment Tuesday but did not immediately hear back.

On Tuesday, Patch reported about a disabled veteran named Richard Osthoff, whose dog Sapphire needed surgery in May 2016:


When Sapphire developed a life-threatening stomach tumor, Osthoff, now 47, learned the surgery would cost $3,000. A veterinary technician took Osthoff aside and told him, “‘I know a guy who runs a pet charity who can help you,’” Osthoff recounted.

His name was Anthony Devolder, and his pet charity was called Friends of Pets United, the vet tech told him.

“Anthony Devolder” is an alias used in the past by Santos, who says his full name is George Anthony Devolder Santos.

Osthoff said “Devolder” set up a GoFundMe for Sapphire, closed the page after it reached $3,000, and never gave Osthoff the money for his dog’s surgery. Sapphire died several months later.

Santos denies the charge and claimed he has “no clue” who Osthoff is. However, Semafor’s Benjy Sarlin flagged a tweet from 2016 promoting an animal fundraiser being held by “Anthony Devolder.”


Elected to the House in November, Santos has come under fire after it’s been revealed he has fabricated much of his life story. He also faces questions about a $705,000 loan he gave his 2022 campaign after reporting he had no assets and a $55,000 salary in 2020.

Osthoff and a veterans’ activist named Michael Boll, who tried to help Osthoff get the money, joined CNN’s Erin Burnett on Wednesday’s OutFront.

“At what point did you all realize that Anthony Devolder is George Santos?” the host asked.

“A week ago,” Osthoff replied.

“A week ago?” Burnett said, incredulously.

Osthoff explained further:

And I knew his voice. And that was the only thing I knew about him. And I saw him on TV and I was like, “I got a feeling in the pit of my stomach about this guy. Who is he and why do I recognize him?”

And then, that was in December right around Christmastime. Just about a week ago, he was in the Capitol and there was a bunch of reporters following him around asking questions. That’s about the only thing you see of him anymore. And one of them said, “What’s your name today? Is it Anthony Devolder or is it George Santos?”

Osthoff told Burnett, “I was sick.”

Burnett read Santos’ denial, which included a claim the congressman “has dozens of people reaching out to me in support sharing their stories about their dogs and cats that I have helped save and rescue.”


“Prove it,” Osthoff said. “Show us.”

The former president on Truth Social Tuesday reposted a post accusing DeSantis of drinking alcohol with minors when he was a high school teacher.

"That's not Ron, is it? He would never do such a thing!" Trump wrote sarcastically.

The picture shows a 23-year-old DeSantis standing and smiling between three women with blurred-out faces.

One of the women in the photos is holding a brown glass bottle but DeSantis isn't pictured drinking. The caption on the post reads, "Here is Ron DeSantimonious grooming high school girls with alcohol as a teacher," followed by the vomit emoji.
