Krebs files lawsuit against Trump attorney who said he should be shot

The former head of U.S. cybersecurity, Christopher Krebs, on Tuesday filed a lawsuit against the Trump campaign lawyer who suggested that he should be “shot.”

The suit accuses attorney Joe diGenova and the Trump campaign of defamation and inflicting emotional distress, The New York Times reported. He alleges that he received death threats in tweets and emails, which forced him and his family to leave their home.

The lawsuit comes one week after Krebs said he was looking at “legal opportunities” over diGenova's comments.

The attorney suggested that Krebs should be “taken out at dawn and shot” during an interview on “The Howie Carr Show.”

DiGenova has since claimed the comment was “in jest,” and told The Washington Post last week that he meant it as a joke.

The suit filed on Tuesday alleges that the president, his reelection team and Newsmax have been engaging in “a calculated and pernicious conspiracy” to defame Krebs and others in the Republican Party who have pushed back against the president’s false claims of voter fraud, according to the Times.

Krebs, along with the Cybersecurity and Infrastructure Security Agency (CISA), released a statement after the election with other election officials that determined the 2020 election had been the most secure in U.S. history.

Following the statement, reports surfaced that Krebs anticipated being terminated from his post. And several days later, he was fired by Trump and the president took to Twitter to allege that Krebs's statement on election security was "inaccurate."

Krebs has stood by his assertion in interviews and statements since.

The suit argues that defendants “have a symbiotic relationship,” according to the newspaper. The filing further alleges that Newsmax amplified the campaign’s attacks on the election process, which in turn “pleases viewers, prompts endorsements from President Trump, increases ratings, supports the political goals of the campaign, and helps raise more money from duped supporters.”

The suit states that Trump has hit Georgia Gov. Brian Kemp (R) and Arizona Gov. Doug Ducey (R) for not agreeing to help overturn election results in those states.

It also states that Trump and his legal team have been trying to persuade GOP leaders in states like Pennsylvania to “ignore certified election results” and have state lawmakers appoint delegates to the Electoral College.

Krebs is seeking monetary damages, and is asking for the video of the Trump campaign lawyer to be removed.

Newsmax argued in a statement to The Hill that "claims made by Mr. Krebs in his suit of a 'conspiracy' and defamation against him are a threat to free speech and his legal action endangers all media organizations that seek an open discourse of ideas and news."

When investigators searched Rogers' house in January, he allegedly had five pipe bombs, which court documents say were live. They also allegedly seized between 45 and 50 firearms, including at least three fully automatic weapons and thousands of rounds of ammunition.

In text messages obtained by investigators and included in the federal indictment, Rogers and Copeland allegedly laid out their plan to bomb the building.

"I want to blow up a Democrat building bad," Rogers wrote, according to the indictment.

They then discussed their target and Rogers said he was "thinking sac office first target," to which Copeland agreed.

"I agree. Plan attack," Copeland said, according to the court documents.

As the exchange concluded, Rogers allegedly wrote: "Let’s see what happens after the 20th we go to war."

Shortly after Rogers was arrested in January, court documents say that Copeland contacted a militia group that Rogers allegedly belonged to, and the group instructed Copeland to destroy his phone.

Rogers and Copeland were previously charged federally via criminal complaint for allegedly possessing explosive devices and wanting to go after Democrats, but the complaint did not mention a planned attack on the Sacramento Democratic headquarters.

According to the complaint, investigators found a Three Percenters sticker on Rogers' truck. The FBI has said the Three Percenters is a "radical militia group" with ties to the Capitol siege. Investigators also said they found a "White Privilege Card."

A lawyer for Rogers declined to comment, and Copeland's lawyer could also not be reached.

The special agent who authored the complaint wrote that he believes the messages show an intent to cause violence to prevent now-President Joe Biden from assuming office.

Rogers also discussed plans to attack Twitter and Facebook for banning Trump and possibly California Gov. Gavin Newsom.

He faces additional weapons and explosives charges in Napa County.

"I hope 45 goes to war if he doesn’t I will," Rogers allegedly wrote.

A Northern California man arrested with a cache of weapons, drugs, and bomb-building materials had a handwritten manifesto indicating that he wanted to target Black, Hispanic, and Jewish people.

Wesley Charles Martines, 32, of the northern California town of Los Gatos, was charged with possession of assault weapons, silencers, drugs, and the makings of a pipe bomb, the Santa Clara district attorney’s office said in a press release Thursday.

Martines was arrested after a business owner called police just after midnight on July 9, saying his security camera picked up a man “prowling” in the area, looking into cars and a storage shed. Police, suspecting a burglary, responded and stopped a truck being driven by Martines.

“In his car they found bullets inscribed with such phrases as ‘Cop Killer,'” the DA’s statement said.

Officials also found a manifesto expressing a desire to commit genocide. According to a report by the East Bay Times, the manifesto depicted “violent scenarios/fantasies” and contained writings voicing the defendant’s desire to “wipe out the Black, Hispanic and Jewish populations.”

Pictures released by the Santa Clara police show multiple assault rifles inside a truck, along with a Glock handgun. Photos also show what appears to be a tactical vest containing multiple blades, and a U.S. flag attached at the top.

In a year that kicked off with the deadly Jan. 6 attack on the U.S. Capitol, threats against lawmakers are soaring. In the first three months of 2021, Capitol Police recorded 4,135 threats against members of Congress. If that pace continues, total threats this year will double those in 2020.

It's a trend that has been growing for years, and Capitol Police are scrambling to keep pace. They're rethinking the ways they protect members in Washington and elsewhere, forging closer ties with the FBI and opening satellite offices outside the capital for the first time.

It's changing the job for lawmakers, who must tread a fine line between being accessible to the people they represent and keeping themselves, their families and their staffs safe. After Jan. 6, some members temporarily relocated their families over concerns that their homes would be targeted. Some wore bulletproof vests to the presidential inauguration.

“It's difficult, and particularly difficult for the family,” said Rep. John Garamendi (D-Walnut Grove), who as state legislator once had a gun pointed at him during a town hall. “There are risks in this job. There's no doubt about it. We spend millions of dollars to let everybody know who we are. So you become a target.”

Experts blame much of the increase on social media and cable news, and how easy it has become to threaten members of Congress behind the anonymity of the internet.

Four years of President Trump's divisive and racist rhetoric played a role, they say, emboldening people to say things publicly that they might have grumbled about privately in the past.

It's also a side effect of growing partisanship and declining civility. Members have contributed to the problem by sometimes encouraging their supporters to harass political rivals. And activists find it more acceptable to confront lawmakers, not just at town halls, but at the officials' homes or as they eat in restaurants.

Some threats have escalated into violent physical attacks.

Before Jan. 6, there was the 2017 shooting of Republican members of Congress and staff at a practice for the Congressional Baseball Game, and the 2011 shooting of Arizona Rep. Gabrielle Giffords at a constituent event.

The surge in threats has grown exponentially in recent years. In 2016, Capitol Police investigated 902 threats, former House Sergeant at Arms Paul Irving said in a June 2017 letter to the Federal Election Commission. By 2018, there were 5,206 threats, and by 2020, there were 8,613, according to Capitol Police figures provided to the Los Angeles Times.

Cops ‘Laughed’ When Biden Staffers Called 911 for Trump Train Ambush: Lawsuit

Just days before the presidential election, supporters of then-President Donald Trump ambushed a Biden campaign bus on a Texas highway, leaving staffers fearful for their safety and repeatedly calling local law officials for help.

But the City of San Marcos “refused to help,” instead privately mocking the Democratic staffers stuck on the bus and calling them “tards,” according to text messages and 911 audio recordings detailed in an amended federal lawsuit.

The Oct. 30 “Trump Train” incident sent shockwaves across the country after videos showed cars with MAGA flags seemingly trying to force the bus off the road as it headed to Austin for a rally. Trump himself commented on the run-in, retweeting a video of it along with the caption, “I LOVE TEXAS!” Videos showed a white SUV and a black truck colliding during the episode.

“For at least ninety minutes, including during the entirety of the stretch of I-35 inside the San Marcos city lines, the Trump Train pursued and terrorized” the bus, the lawsuit states, adding that occupants “tried to get help. They repeatedly called 911. They requested police escorts.”

But San Marcos cops and city officials “chose not to mount a response” from the moment dispatch received 911 calls pleading for help, the lawsuit alleges.

“Instead, according to text messages and 911 audio recordings obtained by Plaintiffs, they privately laughed and joked about the victims and their distress, including by calling them ‘tards,’ making fun of a campaign staffer’s ‘hard’ breathing, and retorting they should just ‘drive defensively’ or ‘leave the train.’”

The lawsuit, obtained by The Daily Beast, was filed by former state Sen. Wendy Davis, bus driver Timothy Holloway, campaign staffer David Gins, and volunteer Eric Cervini. It names a slew of city officials as defendants, including San Marcos’ director of public safety Chase Stapp, San Marcos Police Corporal Matthew Daenzer, and San Marcos assistant police chief Brandon Winkenwerder, and the city itself.

The lawsuit alleges San Marcos Police chose not to provide the Biden bus with a police escort despite multiple requests, and even refused “to take reasonable steps to protect both Plaintiffs’ safety and their foundational democratic rights.”

In a call transcript detailed in the suit, San Marcos Police Corporal Matthew Daenzer told a 911 dispatcher who had fielded a call from a terrified Biden campaign staffer: “No, we’re not going to do it. We will ‘close patrol’ that, but we’re not going to escort a bus.”

In a separate call, a New Braunfels dispatcher relayed a request for a police escort once the bus entered San Marcos’ jurisdiction. The dispatcher said the caller was “really worked up over it and he’s like breathing hard and stuff, like, ‘they’re being really aggressive.’ Okay. Calm down.”

“Yeah, well, drive defensively, and it’ll be great,” Daenzer responded. “Or leave the train. There’s an idea,” the dispatcher added.

According to the transcript in the lawsuit, the dispatcher eventually told the Biden staffer that the request for a police escort was denied—before adding: “If you feel like you’re being threatened or your life is threatened, definitely call us back.”

“Are you kidding me, ma’am?,” the staffer responded before stressing that the Trump supporters had “threatened my life on multiple occasions with vehicular collision.” The staffer again begged for an escort but the dispatcher refused, saying the order came “from our chief,” according to the suit.

The Biden campaign eventually canceled the event in the battleground state just days before the Nov. 3 election. The lawsuit states that a campaign volunteer informed Cole Stapp, a deputy in the San Marcos City Marshal’s department, of the cancelation and asked for help to still get the bus to the venue. Stapp allegedly called 911 dispatch to report the cancelation, but didn’t relay the request about the bus.

​​“Despite these multiple calls for help from Plaintiffs and others, for the roughly 30 minutes it took to drive through San Marcos on the main highway that runs through it, there were no officers from San Marcos or any other police cars in sight—not on the I-35 exit or entrance ramps, nor on either side of the highway,” the lawsuit says, noting that, without police intervention, Trump’s supporters felt embolden to continue their attack on the bus.

As the bus approached the city of Kyle, the lawsuit states, calls from terrified staffers were transferred to the Kyle Police Department.

“Shortly thereafter, a police escort arrived in Kyle, granting the bus a short reprieve,” the lawsuit says. “The Trump Train again de-escalated its harassing behavior and resumed driving at around the posted speed limit.”

But once the bus barreled toward the Travis County limit, and the Kyle police escort left, “the Trump train resumed their threatening behavior.”

The lawsuit states that in the days following the incident, “the officers realized that what had occurred in San Marcos might lead to political and legal consequences, calling the event a ‘debacle’ in internal emails and bracing themselves for a ‘political firestorm.’”

On Nov. 4, the lawsuit states, Daenzer tried to even downplay his department’s actions in his report, stating that “due to the staffing issues, lack of time to plan, and lack of knowledge of the route, we were unable to provide an escort.”

The amended suit, filed by several Democrats including former state Senator Wendy Davis, is asking for damages and a jury trial, stating that “as a result of the events of October 30, including those that occurred in the City of San Marcos, Plaintiffs suffer ongoing psychological and emotional injury.”

No one has been charged over the incident, but the FBI announced last November they had opened an investigation into alleged harassment.

Coffman, who is from Alabama, originally faced 17 firearm charges. He was among the first to be charged in connection with the events of Jan. 6, when scores of supporters of Donald Trump attempted to breach the Capitol building in an attempt to stop the Electoral College from certifying the results of the 2020 presidential election.

Gosar could also join Rep. Marjorie Taylor Greene (R-Ga.) in losing his committee assignments. Greene was sanctioned earlier this year for, among other things, having also promoted violence against Democrats.

The process is again being spearheaded by those same Democrats, while Republicans seem prepared to mostly give Gosar a pass, as they did with Greene. Whether it actually merits censure is now being debated. But one thing is abundantly clear: The explanations for the GOP giving Gosar that pass don’t really add up.

Republicans have generally been tight-lipped about the situation since Gosar posted the video more than a week ago. They have been down this road many times in the Trump era, in which extreme lawmakers have been emboldened to do and say such things (Donald Trump himself often promoted metaphorical violence against his foes), and mum is generally the strategic word.

But the Democrats’ push to censure Gosar has now forced Republicans to weigh in. And Tuesday and Wednesday, they pretended as if Gosar had backed off.

Legal experts weigh in after no verdict following day 2 of jury deliberations
House Minority Leader Kevin McCarthy (R-Calif.) stated that lawmakers could not “accept any action or showing of a violence to another member.” But he blamed the post on Gosar’s staff and noted that Gosar had deleted the video after they spoke on the phone about the matter.

“He didn’t see it before it posted,” McCarthy said. “It was not his intent to show any harm.”

House Minority Whip Steve Scalise (R-La.), who was himself the victim of political violence when he was shot at a congressional baseball practice in 2017, echoed McCarthy’s comments. “He put out a statement, and he took the video down,” Scalise told CNN.

As the House took up the matter Wednesday, Rep. Tom Cole (R-Okla.) said that Gosar had admitted “to a lapse of judgement,” and Rep. Matt Gaetz (R-Fla.) stated that Gosar "has already addressed his misguided decision.”

Even Rep. Mario Diaz-Balart (R-Fla.), one of just 11 Republicans who voted to strip Greene of her committees, said, “I thought it was despicable, but he took it down and apologized.”

That would seem to leave the impression that Gosar regretted the episode. Punchbowl News even reported Tuesday that Gosar had expressed such regret to his fellow Republican House members. It said he “apologized.”

Except Gosar himself says that didn’t happen. While touring right-wing media in his defense, Gosar said: “I explained to them what was happening. I did not apologize. I said this video didn’t have anything to do with harming anybody.”

Gosar’s office also indicated shortly after the situation blew up that there were, indeed, no regrets.

“Everyone needs to relax,” Gosar’s digital director, Jessica Lycos, said at the time.

Gosar added Tuesday that targeting the video was akin to canceling him.

“If my cartoon can be banned and my free speech is to be banned, then the Cartoon Network, Nickelodeon, Disney and indeed most of Hollywood obviously could be banned as well — not to mention Wile E. Coyote and the Road Runner,” he said.

This is an obviously ridiculous comparison. Cartoons are often violent; that doesn’t mean they depict violence against specific lawmakers in the aftermath of proven efforts to violently target such lawmakers. But even setting that aside, it’s about the opposite of contrition or regret. It’s Gosar saying that taking down the video was wrong, even as he submitted to it.

It’s all a rerun of the Trump era, in which Republicans often pretended that Donald Trump didn’t say what he actually said or that he had backed off it, when the available evidence clearly contradicted that.

Even Gaetz, in the same comments as above, momentarily admitted that perhaps Gosar wasn’t actually contrite.

“Congressman Gosar removed the tweet, and I hope he regrets it,” Gaetz.

That Gaetz had to express such a “hope” a week an a half later reinforces Gosar hasn’t really said what his defenders suggest he has.

The question for Republicans is whether they want to continue to humor Gosar, who has demonstrated a knack for causing them headaches. It wasn’t that long ago that he was also rather unapologetic about appearing at a forum with white nationalists. (Indeed, it’s a wonder that isn’t also mentioned in Gosar’s censure resolution.)

Democrats are in many ways doing the GOP a favor by (likely) punishing Gosar on their own. But Republicans have to wonder what’s going to be next from Gosar, who one could argue has been even more extreme than Greene but just hasn’t rallied much of a movement behind him.

Politico’s Playbook on Wednesday spotlighted what’s really behind the GOP balking at Gosar’s censure: “There’s also a concern among moderate members about having to vote to rebuke every crazy thing their colleagues say, which these days, they argue, is a lot.”

That indeed has to be a concern, just from a raw political perspective. But it is possible to set a line when it comes to promoting even metaphorical violence against your colleagues, especially since we’ve seen people act upon that on multiple occasions in recent years (see: Scalise, Gabby Giffords, Jan. 6, increasing threats against lawmakers, etc.). Deeming everything to be a slippery slope is a recipe for letting pretty much everything slide.

And it would indeed be an invitation for the likes of Gosar to continue causing them problems, which he clearly has few true regrets about doing, given his most recent comments and his recent track record.

As usual, though, the approach seems to be to pretend that the problem isn’t a problem — because recognizing it could lead to a backlash by the base — and to hope it goes away. Good luck with that.
