Matt Gaetz, whom Greenberg has implicated as having also had sex with a 17-year-old girl. But one of the charges to which Greenberg pleaded guilty states that he introduced the girl to several other men who also had sex with her.Gaetz, a onetime friend of the former tax collector, has denied any wrongdoing.

Greenberg, a 36-year-old husband and father, pleaded guilty to six of the 33 counts on which he'd been indicted. They include:

sex trafficking of children.
production of a false identification document.
aggravated identity theft.
wire fraud.
stalking.
conspiracy to commit an offense against the United States.
In the plea agreement, Greenberg committed to cooperating with authorities investigating other crimes of which he might have knowledge, including the sex trafficking. The agreement lists minimum sentences for some of the crimes totaling 12 years in prison, but with his cooperation, that sentence could be reduced by three levels. That means he could get fewer than 12 years in prison, Greenberg's attorney, Fritz Scheller of Orlando, said Monday.

Since it surfaced that Rep. Matt Gaetz's former wingman Joel Greenberg was cooperating with prosecutors in a wide-ranging sex-trafficking investigation, Gaetz has zeroed in on skewering Greenberg's credibility as a witness for the government.


But on Friday, a Daily Beast report indicated that Greenberg may have receipts to back up his claims.

"This is not good news for Matt Gaetz," Sherine Ebadi, a former FBI agent who served as the lead agent in the government's case against the former Trump campaign chairman Paul Manafort, told Insider.

The text messages detailed in the story do not feature Gaetz. They were between Greenberg and his friend Joe Ellicott, who previously worked for Greenberg when he was a Florida tax collector.

According to the report, the texts were exchanged on the encrypted messaging app Signal and with a disappearing time of 30 seconds. But Greenberg took screenshots of the messages, in which he and Ellicott expressed fear that they and others in their circle could face criminal charges for having sex with a minor. Ellicott has not been charged with a crime and did not respond to The Daily Beast's requests for comment.

While Gaetz was not a participant in the conversations outlined in the story, legal experts said the existence of the screenshots could spell trouble for the embattled lawmaker as he continues to cast doubt on Greenberg.

"If Greenberg has texts between himself and Ellicott, it's certainly feasible he has other evidence and was savvy enough to take screenshots of those texts," Ebadi said.

"It seems to follow that he may have kept all the evidence that he may have needed to use for leverage," she added. "I would not feel really comfortable if I was anyone that had committed a crime with him right now because he's kept files on people, potentially, which could be very damning and very useful to prosecutors."

Jeffrey Cramer, a former federal prosecutor who spent 12 years at the Justice Department, echoed that view.

"Greenberg was thinking four steps ahead of Matt Gaetz," he told Insider, adding that the fact that Greenberg kept records of his conversations "absolutely bolsters his credibility."

"You can't cross-examine a screenshot," he said, referring to the text messages. "Greenberg got himself an insurance policy."

Gaetz has not been charged with a crime and has denied any wrongdoing. His spokesperson did not immediately respond to Insider's request for comment on this story.

It's routine practice for investigators to search for additional evidence - like electronic records, emails, and financial documents - to corroborate witness testimony. That's especially true for a witness like Greenberg, who was charged with nearly three dozen felonies and pleaded guilty earlier this week to six of those counts, including carrying out the sex-trafficking of a child.

"The fact that Greenberg has screenshots of his conversations with someone else, in which they talked about their unlawful activities, that certainly helps his credibility with the feds," Neama Rahmani, a former federal prosecutor who worked on drug and human-trafficking cases, told Insider.

"This is an admitted felon and someone who's going to be a convicted sex offender," he added. "Prosecutors have to make sure that he's cooperating and being truthful, not just saying what they want to hear to get a reduced jail sentence."

As far as the text screenshots go, Ebadi said, "it makes Greenberg's statements more credible when he has proof."

'The way you work your way up to the bigger fish is that you cooperate up'
The investigation into Gaetz centers around whether he violated federal sex-trafficking laws. According to The New York Times, he's suspected of having had sex with someone in 2019 who was 17 years old. That same person was involved in the sex-trafficking count against Greenberg.

The Daily Beast previously reported that Greenberg also put it in writing that he and Gaetz had paid for sex with a minor. Greenberg sent the letter to the longtime GOP strategist Roger Stone in a last-ditch bid to obtain a pardon from President Donald Trump in the weeks before he left office in January. And as he did with Ellicott, Greenberg also took screenshots of his conversations with Stone, who has also previously been convicted on felony charges.

Ellicott's name surfaced recently after Politico reported that he was named in a federal grand-jury subpoena that investigators sent to another person.

Along with Ellicott, the subpoena mentioned Gaetz, Greenberg, and former Florida state Rep. Halsey Beshears, who knew Gaetz from their time in the Florida statehouse. Beshears also traveled with Gaetz to the Bahamas in 2018, a trip that investigators are scrutinizing as part of their sex-trafficking probe.

"The way you work your way up to the bigger fish is that you cooperate up," Ebadi said. "So the feds got Greenberg and they could have cooperated him against Ellicott. If they get Ellicott, they might use him to get to Beshears, who they could use, in turn, to get to Gaetz. Taking that sort of path up would not be abnormal at all, and I think it's fairly reasonable."

Flipping witnesses to testify against someone higher up in importance is a standard prosecutorial tactic. And if a case like this ends up going to trial, Ebadi said, "when all these people are saying the same thing, that's a lot more powerful, believable testimony than just that of one cooperator who's a convicted felon."

MIAMI — Federal prosecutors are examining whether Rep. Matt Gaetz obstructed justice during a phone call he had with a witness in the sex-crimes investigation of the Florida congressman, according to two sources familiar with the case.

The witness in question was one of a handful of women who entered Gaetz’s orbit via his one-time “wingman,” former Seminole County, Fla., tax collector Joel Greenberg, who pleaded guilty last month to a host of crimes, including sex-trafficking a 17-year-old in 2017.


The obstruction inquiry stems from a phone call the witness had with Gaetz’s ex-girlfriend. At some point during the conversation, the ex-girlfriend patched Gaetz into the call, sources said. While it’s unknown exactly what was said, the discussion on that call is central to whether prosecutors can charge Gaetz with obstructing justice, which makes it illegal to suggest that a witness in a criminal case lie or give misleading testimony.

The witness later spoke with prosecutors, the sources said.

Gaetz has denied all wrongdoing, including obstructing justice or having sex with the trafficked 17-year-old, who was a friend of both Gaetz’s ex-girlfriend and the witness prosecutors interviewed.

The obstruction probe is the latest development in the ongoing federal investigation into Gaetz, a top ally of former President Donald Trump who has come under increasing scrutiny due to his relationship with Greenberg — now a cooperating witness. The obstruction inquiry signals how wide a net federal prosecutors are casting to possibly ensnare the congressman.

A spokesman for Gaetz provided a written statement that stated the congressman — who is an attorney — broke no laws and characterized the federal government’s investigation as a politically motivated fishing expedition.

“Congressman Gaetz pursues justice, he doesn’t obstruct it,” the statement said. “The anonymous allegations have thus far amounted to lies, wrapped in leaks, rooted in an extortion plot by a former DOJ official. After two months, there is still not a single on-record accusation of misconduct, and now the 'story' is changing yet again.”

Gaetz’s statement also said his lawyers are simultaneously investigating an alleged shakedown scheme that was purportedly organized by a former federal prosecutor in reaction to the case.

Brian Tannebaum, a veteran federal defense attorney briefed by POLITICO on the investigation, said that obstruction of justice is “widely used by prosecutors in various forms” and can even ensnare witnesses who lie on the stand at trial. He said that, if authorities recorded the call involving Gaetz, prosecutors will listen for signs that he’s trying to get the woman to “get her story straight” by shading the truth.

“If there’s any indication he was trying to influence her testimony, that can be obstruction,” Tannebaum said. “If it’s determined that what he said obstructed the investigation — ‘did what he tell you have any influence on your testimony before the grand jury?’ — it can be real problem.”

Neither Gaetz’s ex-girlfriend nor the witness on the call could be reached for comment. POLITICO is not naming either woman or the then-17-year-old victim of Greenberg’s sex-trafficking to respect their privacy.

The Justice Department declined to comment.

The former Gaetz girlfriend who was on the call in question, meanwhile, is seeking an immunity deal from prosecutors and has expressed fears to friends that she too may have run afoul of an obstruction of justice charge. She told friends that she feared the alleged trafficking victim may have recorded her in another phone call.

Though Gaetz’s ex-girlfriend has not signed an immunity deal yet, she might do so by the end of the month, according to insiders with first-hand knowledge of the investigation into Gaetz who say July could be a prime time for the congressman to be indicted if there’s enough evidence against him. Greenberg is already cooperating with the federal government, and there are signs that the woman he sex-trafficked as a minor is cooperating as well.

Gaetz dated his ex-girlfriend in 2017 and 2018, but they had an open relationship that involved other women, including the one involved in the three-way call under examination from prosecutors, according to two sources familiar with the relationship. Those two women joined Gaetz and others — including Greenberg’s sex-trafficking victim after she turned 18 — on a jaunt to the Bahamas in late 2018.

Prosecutors are also examining that trip to see if Gaetz or others violated a federal law, the Mann Act, which prohibits transporting people across state lines to engage in prostitution.

Gaetz has consistently denied paying for sex or prostitutes but has acknowledged engaging in so-called “sugar daddy” relationships with the women he met through Greenberg, who in turn found many of them on the SeekingArrangement website for men looking for relationships with younger women.

But while SeekingArrangement relationships might not meet the legal definition of prostitution for a Mann Act case, experts say that the federal sex-trafficking of a minor statute has a broader definition of financial transactions. If a suspect had sex with someone under the age of 18, and if something of value changes hands, then a suspect can be charged.

An attorney representing one of the people of interest to authorities in the investigation said prosecutors have interviewed “numerous women” and that there were “wild sex parties involving drugs, multiple women.” But, because of the wide ambit of the sex-trafficking of a minor statute, it could rope in some of the women who were sexually involved with the 17-year-old in 2017.

“Sex trafficking of a minor involves two prongs in this case: did you have sex with [the 17-year-old] and did anything of value change hands? If the answer is yes, and if any of these other women were involved, why are they not facing charges as well?” the lawyer asked.

“If the federal government wants to call a bunch of people to the state who sex-trafficked a minor in order to bust Gaetz for the same crime, it’s an avenue for his defense if it gets that far.”

A federal prosecutor specifically told the judge in this case that Greenberg "was a prolific criminal," who has provided information on several "lines of investigation we are pursuing." The U.S. attorney's office sought additional time "because of the need to follow up on some of these leads."

As part of yesterday's hearing, the prosecutor added that Greenberg has raised allegations that "take us to some places we did not anticipate."

Gaetz's name was not mentioned. The GOP congressman has denied wrongdoing, though he has acknowledged the Justice Department investigation.

However, Herschmann noted that the pardon Gaetz was angling for may have been intended to also protect him from the sex trafficking investigation swirling around him.

“The pardon that he was discussing, requesting, was as broad as you could describe, from... the beginning of time up until today, for any and all things,” Herschmann told the committee.

After the revelation, Gaetz posted on Twitter to accuse the committee of being “an unconstitutional political sideshow” that is “rapidly losing the interest of the American people and now resorts to siccing federal law enforcement on political opponents.”
