Powell told courts that the witness is an expert who could show that overseas corporations helped shift votes to President-elect Joe Biden. The witness’s identity must be concealed from the public, Powell has said, to protect her “reputation, professional career and personal safety.”


The Washington Post identified the witness by determining that portions of her affidavit match, sometimes verbatim, a blog post that the pro-Trump podcaster Terpsichore Maras-Lindeman published in November 2019. In an interview, Maras-Lindeman confirmed that she wrote the affidavit and said she viewed it as her contribution to a fight against the theft of the election.

“This is everybody’s duty,” she said. “It’s just not fair.”

In a recent civil fraud case, attorneys for the state of North Dakota said that Maras-Lindeman falsely claimed to be a medical doctor and to have both a PhD and an MBA. They said she used multiple aliases and social security numbers and created exaggerated online résumés as part of what they called “a persistent effort . . . to deceive others.”

Powell’s reliance on Maras-Lindeman’s testimony may raise further questions about her judgment and the strength of her arguments at a time when she is becoming an increasingly influential adviser to the president. Trump’s legal team distanced itself from Powell last month after she falsely claimed Republican state officials took bribes to rig the election. But she has visited the White House three times in the past week, once to participate in an Oval Office meeting. Trump has weighed naming Powell a special counsel to investigate the election, according to previous reports.

Texas' Dan Patrick (R) offered financial rewards for evidence of voter fraud. Then Pennsylvania's John Fetterman (D) came calling.

And while that may have seemed like a straightforward task, producing evidence of a systemic problem that does not exist is quite a bit tougher than it sounds. To that end, Texas Lt. Gov. Dan Patrick (R) announced seven weeks ago that he'd be willing to pay up to $1 million as a reward to those who could produce proof of fraud.

At the outset, this appeared to be unwise. As we discussed last month, the Texas Republican was effectively arguing that he and his party assumed there was widespread fraud, but they couldn't prove it, so he hoped financial rewards would produce evidence Republicans couldn't find on their own. But now there's a related problem: Patrick's counterpart in Pennsylvania has uncovered real-world evidence of Trump voters committing fraud, and he wants the Texan to pay up. The Houston Chronicle reported:

All John Fetterman wants for Christmas is the $3 million he says Texas Lt. Gov. Dan Patrick owes him. The Democratic lieutenant governor of Pennsylvania has been trolling his Republican counterpart for weeks to collect on the $1 million Patrick offered in November for evidence of fraud in the Nov. 3 election. Three supporters of President Donald Trump have now been charged in separate voter fraud schemes in Pennsylvania. Fetterman says they should all count for bounty purposes.

The landscape has to be discouraging for those inclined to believe baseless Republican conspiracy theories about the election. For all the hysterical rhetoric, only a handful of legitimate allegations have been raised, and some involve Republicans casting illegal ballots for Trump on behalf of dead relatives.

In fact, this is exactly what Fetterman found in Pennsylvania, which is why the Democratic lieutenant governor wants Dan Patrick to pay the reward. (Fetterman has vowed to donate proceeds to local food banks.)

Fetterman explained to the Chronicle that he's pushing the issue in part to discredit baseless Republican smears against the elections. "While it's undoubtedly and undeniably hilarious these cases involved Trump voters and their dead mothers, it's irrelevant because it documents how truly rare voter fraud is and how impossible it is to truly pull it off," the Pennsylvania said.

For his part, a spokesperson for Patrick replied, "It is not clear why Lt. Gov. Fetterman continues on this topic since Democrats don't believe in voter fraud — unless it's the Russians."

A federal judge has thrown out a lawsuit from Rep. Louie Gohmert of Texas and several Arizona Republicans seeking to force Vice President Mike Pence to help throw the election to President Donald Trump next week when Congress meets to count the Electoral College votes.

Judge Jeremy Kernodle of the Eastern District of Texas said on Friday that Gohmert and the others lacked standing to sue.

The principle of standing as a way to access judicial review was limited by a conservative court, in part, if memory serves, to limit class action lawsuits against businesses. Here is a footnote referring to the case I remember.

Standing is more elemental than that. It's a basic legal concept.

Black’s Law Dictionary:

standing to sue “means that party has a sufficient stake in an otherwise justiciable controversy . . . to obtain judicial resolution of that controversy. . . .Plaintiff must have a legally protectable and tangible interest at stake in the litigation.

If you get booted for lack of standing, your suit was bogus and fees should be awarded against you. Even a 1st year law student knows when there is, and when there is not, standing of a party.

Indeed. In politics, it's hard to top this criminal conduct.

"All I want to do is this: I just want to find 11,780 votes, which is one more than we have, because we won the state," Trump stated at one point.

"You know what they did and you're not reporting it," the president said. "You know, that's a criminal - that's a criminal offense. And you know, you can't let that happen. That's a big risk to you and to Ryan, your lawyer. That's a big risk."
