When the State takes a person into custody, the State is responsible for the well being of the detainee. The State is acting in loco parentis with respect to a child being held.
If your neighbor's kid died while in custody of his or her parents, I'm sure you would not have such a glib response. You might wonder how could a parent allow a child to die on their watch. |
