A Colorado judge gave a scathing rebuke to a pair of lawyers after he dismissed their case challenging the results of the 2020 election, suggesting they were just parroting former President Donald Trump's talking points.


Lawyers Gary Fielder and Ernest John Walker filed a class-action suit in December last year, claiming to represent the voting rights of 160 million Americans. They accuse a slew of high-profile politicians and tech CEOs of thwarting a Trump election victory with China and Iran's help, according to court documents seen by Insider.

The pair have bankrolled their case via a crowdfunding page calling it "the largest civil rights class-action lawsuit in history."

The case was dismissed in April, one of the numerous failed attempts to implicate voting technology company Dominion Voting Systems in an alleged plot to steal the election for Joe Biden.

But Federal Judge N. Reid Neureiter found the case so frivolous that he called Fielder and Walker in for a hearing Friday to ask them if they had been used "as a propaganda tool" for Trump, The Washington Post reported.

"Did that ever occur to you? That, possibly, [you're] just repeating stuff the president is lying about?" Neureiter said, referring to Trump, the Post reported.

Fielder and Walker argued that they filed the case in good faith, and plan to re-file the case despite the threat of sanction from Neureiter, the Post reported.

Theirs is one of several cases that appears to be heavily influenced by evidence-free claims by the former president, despite none of them having succeeded in court.

It also named Mark Zuckerberg and Priscilla Chan, Georgia Secretary of State Brad Raffensberger, and Michigan Gov. Gretchen Whitmer as defendants in a loosely-woven series of allegations of Democratic bias and unconstitutional modifications of electoral law.

It asks damages of $1,000 for every registered voter in the US.

Neureiter asked the lawyers if they had thoroughly investigated the case's claims, such as that Dominion Voting Systems' machines had allowed Chinese and Iranian tampering, NBC's 9 News reported.

Two days before Walker and Fielder filed their case, then-Attorney General Bill Barr announced that the FBI had seen no evidence of widespread voter fraud. In November, Chris Krebs, then-director of the Cybersecurity and Infrastructure Security Agency, publicly stated that the election was the "most secure in American history."

Neureiter compiled a list of factors that a "non-frivolous" lawsuit should be ready to consider, including Barr and Krebs' statements. He told the lawyers that they should have been a "red light for you, at least a flashing yellow light," the Post reported.

Fielder and Walker did not immediately respond to Insider's request for comment.

Daunt, who previously challenged Michigan's "sloppy" voter rolls, was appointed in January to the board, which is tasked with certifying election results. Also a member of Michigan's Republican State Committee, Daunt is of the camp that doesn't see Trump as an asset to the party and, with midterms next year, condemns him for harping on the last election.


"I just want to thank you...for having the courage to stand up against the malignancy that is Donald Trump and the people who have lacked the courage to stand up to him for the last six months," Daunt said after state Senator Ed McBroom presented the Senate Oversight Committee's report, according to The Detroit News.

Trump narrowly won Michigan in 2016 but lost it last November to President Joe Biden by about 3 percentage points. With 16 electoral votes, it was considered a critical state for Trump, and in the wake of the 2020 election, his team fought to see the results overturned.

Seven months after the election, the Republican-controlled Senate Oversight Committee published a report on its findings. The committee concluded there was "no evidence of widespread or systematic fraud," which contradicts Trump's claims. It also said those who have touted Antrim County as "prime evidence" of a conspiracy to steal the election have "zero credibility."

An Associated Press investigation found 182 cases where problems were clear enough that officials referred them to investigators for further review. So far, only four cases have led to charges, including those identified in a separate state investigation. No one has been convicted. No person's vote was counted twice.

Barry County Sheriff Dar Leaf has claimed, as has Trump, that there was voter fraud leading to President Joe Biden's win in the 2020 election. This claim has led the sheriff to open an investigation into voting machines in Barry County, as officials there have denounced the probe as "absolutely ridiculous and ludicrous," CBS local affiliate News Channel 3 reported on Friday.

While Biden won Michigan by more than 150,000 votes—or about 2.8 percent—Trump won Barry County by a wide margin. Official election results from the county showed Trump garnered 23,471 votes there compared to just 11,797 that went for Biden. With 36,146 total ballots cast in Barry County, that means Trump won about 65 percent of the vote while Biden garnered less than 33 percent.

The claims come in an extract of Washington Post journalists Carol Leonnig and Philip Rucker’s new book I Alone Can Fix It: Donald J Trump’s Catastrophic Final Year, released this week.

According to the journalists, Mr Pence refused to evacuate the Capitol a number of times on 6 January as pro-Trump rioters stormed the building in a bid to prevent the certification of the 2020 election results.

Amid the riots Mr Pence was evacuated from the Senate chamber to his ceremonial office, where he remained protected by secret service agents alongside members of his family, the book’s account recalls.

However, his security reportedly thought Mr Pence was “vulnerable because the second-floor office had windows that could be breached”.

Tim Giebels, the lead special agent in charge of the former vice president’s protective detail, reportedly “twice asked Pence to evacuate the Capitol” to which Mr Pence refused, The Post said.

“I’m not leaving the Capitol,” he reportedly told Mr Giebels. “The last thing the vice president wanted was the people attacking the Capitol to see his 20-car motorcade fleeing. That would only vindicate their insurrection.”

As the chaos continued to unfold, Mr Pence was said to have been ordered to leave the office and was escorted to a “subterranean area that rioters couldn’t reach” and towards an armoured limousine.

Mr Pence then reportedly outright refused to get into the vehicle, saying his security detail would ignore his demand not to leave the building and would instead “take off” against his wishes.

“I’m not getting in the car, Tim,” Mr Pence replied. “I trust you, Tim, but you’re not driving the car. If I get in that vehicle, you guys are taking off. I’m not getting in the car.”

According to RawStory, MSNBC host Nicolle Wallace said that sources with knowledge of the day said Mr Pence “feared a conspiracy, feared that the Secret Service would aid Trump and his ultimate aims that day”.

She added: “This is the most harrowing version of Mike Pence’s day I’ve seen reported.”

During the insurrection, Mr Pence was made a target of rioters’ fury following inflammatory statements by Donald Trump, with many heard shouting “Where’s Mike Pence?” and “Hang Mike Pence”.

Mr Trump and his supporters were angry at the vice president for refusing to block the electoral certification, a power he did not possess.

Mr Trump called on Mr Pence to overturn the results only hours before their certification saying: “All Mike Pence has to do is send them back to the States, AND WE WIN. Do it Mike, this is a time for extreme courage!”

On the afternoon of 6 January the former president Tweeted: “Mike Pence didn’t have the courage to do what should have been done to protect our Country and our Constitution.”

Mr Pence and the other lawmakers who had been evacuated later returned to the Senate chamber to see out the certification of the election results.

The Independent has contacted Mr Pence’s political advocacy group, Advancing American Freedom, for comment.

Bob Dole wasn't one of those establishment types who stuck up their nose about Donald Trump's hostile takeover of the Republican Party in 2016. He endorsed the billionaire businessman in that race and was the only former presidential nominee to attend the Republican National Convention that nominated Trump to be the GOP's standard-bearer.

All of which is why what Dole, who spent decades in the Senate and was the 1996 GOP presidential nominee, told USA Today's Susan Page this week about Trump all the more telling.

"I'm a Trumper," Dole told Page, adding later: "I'm sort of Trumped out, though."


What explains Dole's fatigue with Trump? At least in part the latter's focus on contesting an election that was quite clearly conducted fairly.

"He lost the election, and I regret that he did, but they did," Dole said. "He had Rudy Giuliani running all over the country, claiming fraud. He never had one bit of fraud in all those lawsuits he filed and statements he made."

The problem for Dole as well as the likes of Senate Minority Leader Mitch McConnell and a handful of other establishment Republicans is that they are lonely voices in the wilderness. The bulk of the base not only approves of Trump but is also on board with his ongoing attempts to push debunked conspiracy theories about fraud in the 2020 election.

Although only 34% of all voters approved of the job Trump was doing in Gallup's final poll of his presidency in early 2021, more than 8 in 10 self-identified Republicans (82%) said they approved -- a massive disconnect that makes clear that even if Trump is disliked in the country at large, he remains a hero to a large swath of the Republican base.

Then there are his wild and false claims about the election.

In polling conducted by Democracy Fund, a nonpartisan foundation dedicated to the study of democratic institutions, that was released in late June, 86% of Republicans said Trump's legal challenges to the 2020 election were appropriate, 79% said they weren't confident in the national vote tally and 68% said Trump really won. Another 54% said Trump should never concede.

So, yeah.

It remains to be seen whether Trump's single-minded focus on somehow "proving" that he actually won the election will eventually lead some significant chunk of Republicans to, like Dole, tire of him.

What makes me skeptical of Dole leading a movement of former Trumpers away from him is that Trump has always had only one gear, only one schtick that he always used. The elites are against him (and you). "Fake News." "Make America Great Again."

To quote Jacobim Mugatu in "Zoolander": "The man has only one look."
