Two DOJ watchdog entities will battle over who gets to investigate John Durham for corruption probe
Quote: | New York Times reporter Charlie Savage was on the team of reporters that broke the recent report that special counsel John Durham and Attorney General Bill Barr were corruptly using the Justice Department in an attempt to discredit Robert Mueller's investigation. The effort failed, but only after nearly four years and $6.5 million in taxpayer dollars.
Two former prosecutors, now serving in Congress, have asked the inspector general at the DOJ to begin a probe into the conspiracy, but there's another entity under the department that could also be jockeying for the investigation: OPR - the Office of Professional Responsibility. OPR was started after Watergate in an effort to ensure the ethical standards of lawyers working under the DOJ.
Savage told MSNBC's Nicolle Wallace that the investigation would likely look at the draft of the interim report ahead of Durham's "No. 2" in the probe that ultimately quit.
"They would want to know more about how Durham used a grand jury authority to obtain access to the e-mails of George Soros' aide after a federal judge twice ruled his evidentiary basis for trying to get after that information about those e-mails and intrude on that person's privacy was legally inadequate. So, that would be two big avenues of discussion, as well as, what was this criminal investigation involving some sort of financial crime linked to Trump. Did they pursue it? How did they pursue it? What happened to that? Charges were never brought."

Wallace said that for years she's wondered "why they do it," meaning people who had respectable reputations are willing to compromise themselves for Donald Trump. She also pointed out that Inspector General Michael Horowitz allowed a statement to go out from Durham that contradicted the Justice Department. It led her to wonder if there is a higher place for accountability.

Former CIA Director John Brennan began by agreeing that the whole prob was "politically motivated" and had "a fair amount of unethical and professionally inappropriate activities." It included Barr's behavior of "kowtowing to Donald Trump."
"Charlie's reporting raises some serious questions about whether or not this misconduct might have risen to the level of criminal activity or needs to be investigated by DOJ," he said. "It's very unfortunate it's taken up so much time and money when it's clear that this was a witch hunt trying to disprove the assessment that was done by the intelligence community that Russia was trying to interfere in the 2016 presidential election on behalf of Donald Trump." |

Documents about fake Bill Barr investigation of Trump obstruction of justice must legally be released
Quote: |
The deadline to release the Justice Department documents federal Judge Amy Berman Jackson ruled must be revealed is Monday, May 24.
Judge Berman Jackson's 35-page opinion in Citizens for Responsibility and Ethics in Washington v. U.S. Department of Justice confirmed that former Attorney General Bill Barr lied to Congress when he said that he worked with other DOJ lawyers to decide whether or not to indict then-President Donald Trump.
She didn't release the document in early May because she gave the DOJ time to appeal her ruling if they wanted. Thus far, the DOJ hasn't appealed, meaning they'd have to file it Monday morning or the information will be released.
In an episode of Rachel Maddow after the ruling, the MSNBC host explained that not only did Barr lie about the decision, he also created a fake paper trail to act as if there was a broader conversation with DOJ lawyers.\
Calling it "a heck of a thing," Maddow explained that the new White House has made it clear that they want to look forward, not back. At the same time, the new White House has also said that they have no intention of meddling with the Justice Department's decisions or cases.
"Merrick Garland is the attorney general now, all new leadership at the Justice Department, all new priorities, moving forward with a million things at once, and here's a judge saying, you know, your immediate predecessor in this job lied to me, lied to the court and lied to the American public about something as freaking serious as why the former president was not charged with crimes," Maddow continued. "You cool with the evidence of all of that being released to the public? Because it's coming out in two weeks unless you want to appeal my ruling."
The question has become, if there was no actual conversation or Justice Department investigation into whether Trump should be held accountable for the obstructions of justice cited by special counsel Robert Mueller. The difference between now and then is that before Trump was president and protected by the Office of Legal Counsel decision that dictated a president couldn't be indicted. Trump doesn't enjoy that protection now.
There's also a question of whether or not Barr should garner a criminal investigation for lying to the court, Congress and the American people and falsifying documents to justify his behavior. |

Bill Barr delivers devastating takedown of Trump’s Jan 6 indictment defence
Quote: | Former attorney general Bill Barr slammed Donald Trump and his defence of the four federal charges he’s facing, saying the ex-president turned people’s lives upside down in pursuit of allegedly trying to overturn the 2020 election and his argument that it was his First Amendment right is invalid.
Mr Trump was indicted on four charges stemming from a Department of Justice investigation into his alleged efforts to overturn the 2020 election and the subsequent January 6 attack on the Capitol earlier this week
The ex-president argues the indictment is politically motivated and an attorney for Mr Trump accused the DoJ of having “criminalised” Mr Trump’s First Amendment right to free speech.
But Mr Barr disagrees.
“As the indictment says, they’re not attacking his First Amendment right, he can say whatever he wants he can even lie, he can even tell people that ‘the election was stolen’ when he knew better but that does not protect you from entering into a conspiracy,” Mr Barr said on CNN’s The Source with Kaitlan Collins.

Mr Barr, who served as attorney general in the Trump administration from February 2019 until December 2020, left office shortly after the election – in part due to Mr Trump pushing false claims of election interference.

“Free speech doesn’t give you the right to engage in a fraudulent conspiracy,” Mr Barr said on Wednesday night.
The unsealed indictment specifically says Mr Trump “had a right, like every American, to speak publicly about the election and even to claim, falsely, that there had been outcome-determinative fraud during the election and that he had won” but that he “pursued unlawful means of discounting legitimate votes and subverting election results.”
Mr Barr called Mr Trump’s behaviour outlined in the indictment “despicable”, saying his methods of “bullying” the process of electing a leader means he should not be “anywhere near the Oval Office.”
“And for him to be attacking a prosecutor who is investigating that with all the epithets and so forth, which he has no basis for, as far as I can tell, is ridiculous,” Mr Barr said.
In the wake of the indictment, Mr Trump attacked Special Counsel Jack Smith who is leading several probes into the ex-president’s allegedly unlawful behavior. He discredited his authority in investigating Mr Trump both for his alleged involvement leading up to January 6 and alleged withholding of classified documents.
In many of Mr Trump’s previous legal matters, he has attacked the prosecutors, witnesses and Judges.
Mr Barr, told CNN’s Collins that Mr Trump’s loyalty is a “one-way street” and lies nowhere except within himself. He cited former aides to Mr Trump like his co-defendants in the classified documents case Walt Nauta and Carlos De Oliveira.
“He leaves in his wake ruined lives like this – The people who went up to Capitol Hill, these individuals, many of the people who served him in government that got sucked into things and he just leaves all this carnage in his wake,” Mr Barr said.
As for any advice Mr Barr has for Mr Trump’s attorney, he recommended they “get a lot of insurance. |
