A detail in the indictment of Allen Weisselberg, the longtime chief financial officer of the Trump Organization, has caught the eye of legal experts who say it could be bad news for former President Donald Trump, according to a New Yorker report published Wednesday.

Prosecutors at the Manhattan district attorney’s office charged both Weisselberg and the Trump Organization in July, alleging a 15-year scheme to defraud tax authorities to heavily compensate certain executives at the company off the books.

Among the sprawling allegations, according to the New Yorker, is one that accuses Weisselberg of erasing portions of entries in a ledger called “Donald J. Trump’s Detail General Ledger” during the 2016 presidential campaign. The alleged entries were for tuition payments for Weisselberg’s grandchildren.

Per the New Yorker, people familiar with Trump’s legal troubles noticed one particular element of that allegation: the name of the ledger.

“My jaw literally dropped when I saw that,” Tristan Snell, a former New York assistant attorney general who worked on the Trump University case, told the New Yorker.

“If there was a ledger for him, it blows up the notion that Trump didn’t know about it—it means there was a set of numbers prepared for Donald Trump.”

He told the magazine the public disclosure of the ledger’s existence was a message from prosecutors to Trump: “We have your ledger.”

Weisselberg, who has worked for the Trump family since the 1970s, was reportedly removed from his leadership positions at dozens of Trump Organization subsidiary companies in July following his arrest but retained his CFO title. He and the company both pleaded not guilty to all charges and Trump has dismissed it as a “witch hunt.”

New York Attorney General Letitia James indicated this week that more charges are likely to emerge in her office’s years-long investigation into Trump’s business empire.

well 5 months is too short

But as someone pointed out, he can face other charges that were not settled. And as pointed out when he is in jail they can make his life miserable while there to put pressure on him to know if they get another conviction it would be many years and at his age is he willing to be in such a horrible place. So they could get him to testify against trump finally. Cohen mentioned how the trump people put other pressure on him to keep his mouth shut.

Prosecutors in Manhattan are using the threat of additional charges to pressure Weisselberg into cooperating with their ongoing criminal investigation into former President Donald Trump and his business, the sources said.

A spokesperson for District Attorney Alvin Bragg declined to comment to ABC News. An attorney for Weisselberg also declined to comment.

Weisselberg testified against the Trump Organization at its criminal trial last year as part of a plea agreement, but he did not implicate the former president in the company's tax fraud.

Insurance fraud was mentioned in New York Attorney General Letitia James' $250 million civil lawsuit that the AG brought in September against Trump, his eldest children, and his business. The lawsuit, which also names Weisselberg and other executives, alleges that the former CFO lied to an insurance company about an appraisal of Trump's real estate portfolio.

Trump has denied wrongdoing and has called James' investigation a politically motivated "witch hunt."

This week, prosecutors began presenting evidence to a grand jury investigating whether Trump played a role in the hush money payment to Stormy Daniels ahead of the 2016 presidential election. Among the initial witnesses, ABC News has previously reported, were former National Enquirer publisher David Pecker and Trump Organization controller Jeff McConney.

Trump has denied knowing about the payment, which was arranged through his then-personal attorney, Michael Cohen.

Speaking to MSNBC's Joy Reid on Monday, Trump biographer David Cay Johnston said he expects Weisselberg is going to be hauled into this case and that his problems aren't over yet. Reid asked if this was going to be nothing more than a misdemeanor campaign finance piece. It's something that former FBI counsel Andrew Weissmann explained can be a felony if this is shown to have been a plot used more than once.

Cay Johnston explained that the district attorney could bump the charges to felonies by alleging falsification of business records.

It's a statute that "says if you falsify your business records to further another crime or to conceal it, that itself can be a felony, and that underlying crime does not itself have to be a felony," he said. "So, it's one of these one plus one equals two situations. I have speculated one of the crimes they might be looking at is the one you just cited. It's not a conventional campaign finance violation, rather it's about a group of people coming together to promote somebody's election through unlawful means. I have speculated those unlawful means are Michael Cohen's bank fraud. He got a home equity loan to pay off Stormy Daniels that's fraudulently detained."

Trump and his lawyers have tried to claim that this was all personal and not related to the campaign. The problem is that they were paid in the month before the election. If it wasn't for the election, there would not have been a sense of urgency to handle it before the election. Even Trump's claim that he was scared of Melania, the accusation is that if she left him ahead of the election, it would have been detrimental to his campaign as well.

"Allen is a wholly owned subsidiary of Donald's mind and has been for 50 years," quipped Cay Johnston. "I think the reason that the Justice Department didn't pursue the Michael Cohen case, which looked like a slam dunk, is that they didn't see it as being the biggest case to bring if you're going to go after a former president. On the other hand, Alvin Bragg decided not to go the RICO route, which I thought was a very smart move."

The comment is a reference to the possibility that Trump's payments were part of a racketeering plot, which some legal analysts debated could have been.


"Now he's come back with using the New York state business laws, which could be very effective," Cay Johnston continued. "Two misdemeanors, you get a felony, and his own efforts now by Trump's lawyers are going to be to say, 'Oh, this is all illegitimate the laws are murky. We don't know what we're doing here.' And it may be a broader case than that Weisselberg is right now in jail he has an agreement that he has to fully and faithfully testify. I don't think he did that in his own trial, the one for the Trump Organization and himself but he didn't flake out either completely I'm sure there's been a serious effort to say to him, 'You're going to have to be candid about what happened here and bringing in other witnesses like Jeff McConney, suggest that there's other evidence that Allen Weisselberg knew about these illicit payments."

McConney was the finance guy under Weisselberg. Reid asked if pressure on the Trump Org. is the way they get to Donald Trump.

"It seems to me, if you and I agree, that if I'm going to rob a bank and give you the money, we're both supposed to go to jail, not just me," she said.

Cay Johnston explained that Bragg is working on getting the Trump staff, most of whom are still on his payroll, and get them to face off against "the evidence that they cannot escape."

Trump never uses text messages or email and he tears things up to keep things hidden. So, the information will come from his staff.

time to indict trumps lawyers for criminal activity, these are all the same so it is a crime by repetitiveness and time to pull in more of the clients that have coached in front of grand jury's....

time to set an example that lawyers are not above the law specially from the top... when trying to attack this country and destroy for which it no longer stands.

Weisselberg is not the first one to do something like this. Michael Cohen did it just before he flipped on Trump. Cassidy Hutchinson had a Trump-funded lawyer before she fired him and got another lawyer so she could tell the Jan. 6 investigatory committee the truth about what she learned working for former chief of staff Mark Meadows. Each time a Trump-funded lawyer was fired, it has been an indication that those previous allies were about to turn.

Weisselberg is serving a five-month sentence in Rikers Island Prison, known for being one of the most violent prisons in America. MSNBC's Ali Velshi noted that if someone was trying to get Weisselberg to flip, now would be the time. Last month, the New York Times reported that the Manhattan prosecutor's office was pondering whether to file new charges against Weisselberg for fraud.

Nick Gravante and Mary Mulligan are no longer with Weisselberg.


"Our colleagues at NBC saying that his attorneys, who are being paid for by the Trump Organization to represent Weisselberg, are no longer representing him," said Velshi. It's a big deal. That could potentially explain the delay."

The delay that Velshi is talking about is the idea that Trump claimed eight days ago that he was about to be arrested. He hasn't been. In fact, there's no indication that he's been indicted either. Grand juries are secret, so it's also possible that they have voted to indict and it simply hasn't made its way to Trump yet. It's assumed the information will be leaked by Trump when it happens, because the district attorney can't legally reveal any information from the grand jury.

According to MSNBC's Rubin, testimony he gave under oath to New York Attorney General Letitia James is coming back to haunt him.

As she explained in her column, he appears to have perjured himself when discussing how he became aware that the Trumps inflated the valuation of a property during business dealings.


Rubin wrote, "... a cursory read of those transcripts, coupled with other filings by the attorney general, suggests at least one potential avenue for a perjury charge: Weisselberg’s involvement in the overvaluation of Trump’s triplex apartment in Trump Tower and at what point he knew that valuation was false."


Noting a brief from the AG stated, “Weisselberg admitted that the Statements overvalued Mr. Trump’s apartment by ‘give or take’ $200 million — and evidence later revealed he was provided with the true facts regarding the apartment’s square footage before certifying as accurate the inflated apartment value based on false information,” Rubin added, that Weiseelberg's comments about a Forbes' article he reviewed about the valuation may have been the fatal error that could land him in hot water again.

"'The Forbes article' Weisselberg referenced in his deposition, according to the attorney general’s filings, was not provided to Weisselberg until March 2017, when he, as well as Donald Trump, Jr. and Eric Trump, were alerted that while Trump told Forbes his apartment was roughly 33,000 square feet, the magazine found property records and 'concluded it was less than one third that size,'" she wrote before adding, "Put another way, at least according to the attorney general’s version of events, Weisselberg didn’t learn the valuation was false after the fact, as he testified. Instead, he received documents reflecting the 'true size of the triplex' years before he certified the 2015 financial statement."

Rubin added, "Therefore, the Manhattan DA’s office has a colorable argument that Weisselberg lied under oath during his July 17, 2020, deposition."

"Weisselberg testimony seems highly problematic-and the AG elicited evidence of his substantial monetary reasons he may have to tailor his story- he is still owed hundreds of thousands of dollars as part of his agreement with the Trump co," former Assistant U.S. Attorney Andrew Weissman wrote of the revelation on X, formerly Twitter.
