The use of private email and apps by two presidential advisers could violate the Presidential Records Act. It also would amount to the same activity that Republicans, led by Trump, campaigned on in 2016 as evidence of Hillary Clinton’s alleged criminality.
In his letter to the White House, Rep. Elijah Cummings, D-Md., the chair of the committee, requested documents and information relating to the Trump White House’s use of nongovernmental channels.
Ivanka Trump, Cummings wrote, “continues to receive emails relating to official business on her personal email account” and “she does not forward emails received through her personal account unless she responds to the email, even if the subject matter of the email relates to her official duties.”
That, Cummings said, violates the Presidential Records Act.
Kushner’s lawyer, Abbe Lowell, assured Cummings that his client took screenshots on WhatsApp of all government business conducted on the platform, including the times he has used it to communicate with foreign leaders. When asked whether he had used the app — which is prohibited by the White House — to discuss classified information, Cummings said Lowell replied, “That’s above my pay grade.”
Cummings noted that the revelations about Kushner and Trump’s communications had come to light in 2017, but that “new information that raises additional security and federal records concerns” has since been obtained.
Previous attempts by the committee to obtain information on the use of private email have been rebuffed by the White House, setting up the latest battle between the Democratic-controlled body and the president.
“The White House’s failure to provide documents and information is obstructing the committee’s investigation into allegations of violations of federal records laws by White House officials,” Cummings said in his letter.
“If you continue to withhold these documents from the Committee,” Cummings added, “we will be forced to consider alternative means to obtain compliance,” a not-so-veiled allusion to a possible subpoena.
In the final month of the 2016 presidential race, Donald Trump accused Clinton of “willful and deliberate criminal conduct” in her use of private email while serving as secretary of state. |

She is doing this to harm america, she knows it is false. If she has nothing to hide than release all information.

The criminal inquiry, led by the Manhattan district attorney, Cyrus Vance Jr, and a civil investigation by the state attorney general, Letitia James, are just some of many legal challenges that will probably face the president and his family business when he returns to being a private citizen.
The report provoked a sharp response from Trump’s eldest daughter, who is a senior presidential adviser.
“This is harassment pure and simple,” Ivanka Trump said on Twitter, linking to the report in the New York Times. “This ‘inquiry’ by NYC democrats is 100% motivated by politics, publicity and rage. They know very well that there’s nothing here and that there was no tax benefit whatsoever. These politicians are simply ruthless.”
The Times, which said the two investigations have subpoenaed the Trump Organization in recent weeks, follows publication of Trump’s long-sought tax records and revelations that he personally guaranteed debt running into the hundreds of millions that could soon be called in or come due.
Trump’s financial and legal stresses appear to be mounting. Earlier this month, Reuters reported that Trump’s main lender, Deutsche Bank, is looking for ways to end its relationship with the president.
Deutsche Bank has about $340m in loans outstanding to the Trump Organization, the president’s umbrella group that is currently overseen by his two sons. The loans, which are against Trump properties and start coming due in two years, are current on payments and personally guaranteed by the president, according Reuters.
Among the latest revelations is that he reduced his tax exposure by deducting about $26m in fees to unidentified consultants as a business expense on several projects in the past decade.
Some of those fees, the Times said, appear to have been paid to Ivanka Trump, including a payment of $747,622 from a consulting company that exactly matched consulting fees claimed as tax deductions by the Trump Organization.
Trump Organization counsel Alan Garten described the development as “just the latest fishing expedition in an ongoing attempt to harass the company”.
Details of the twin investigations have been scarce. The Manhattan DA’s inquiry was originally focused on Trump Organization payments to the porn star Stormy Daniels ahead of the Trump’s 2016 election victory but has since expanded to include insurance and bank-related fraud, tax evasion and grand larceny.
The civil investigation began earlier this year after Trump’s former lawyer Michael Cohen told Congress that the president had boosted the value of his assets to secure bank loans and reduced them for tax purposes.
In a TV interview this month, James, the New York attorney general, said the outcome of this month’s election was irrelevant to the investigations. She said: “We will just follow the facts and the evidence, wherever they lead us.”
But Trump has dismissed the investigations as “the greatest witch-hunt in history”. |

WASHINGTON — Ivanka Trump has been deposed by attorneys alleging that President Donald Trump's 2017 inauguration committee misused donor funds, a new court filing reveals.
The document notes that Ivanka Trump, the president's oldest daughter and a senior White House adviser, was interviewed Tuesday by attorneys from the Washington, D.C., attorney general’s office.
The office has filed a lawsuit alleging waste of the nonprofit's funds, accusing the committee of making more than $1 million in improper payments to the president's Washington, D.C., hotel during the week of the inauguration in 2017.
As part of the suit, they have subpoenaed records from Ivanka Trump, first lady Melania Trump, Thomas Barrack Jr., a close friend of the president who chaired the inaugural committee, and others. Barrack was also deposed last month.
Trump confirmed the deposition Thursday on Twitter, saying it lasted more than five hours. She noted the D.C. attorney general is a Democrat and charged, "This 'inquiry' is another politically motivated demonstration of vindictiveness & waste of taxpayer dollars."
The tweet included what Trump said was an email message from 2016 in which she suggested the hotel negotiate and said, "It should be a fair market rate."
On Wednesday, Alan Garten, a lawyer for the Trump organization said similarly that “Ms. Trump’s only involvement was connecting the parties and instructing the hotel to charge a ‘fair market rate,' which the hotel did.”

Yet the documentary interview tells a different story — and Ivanka is going to have to explain what the actual truth is. The House January 6 committee now has her on-record contradicting herself when she trumpeted Donald Trump talking points like “every single vote needs to be counted and needs to be heard, and he campaigned for the voiceless,” per The New York Times. In the documentary interview, she continued, “And he has to take on this fight. Look, you fight for what you love the most and he loves this country, and he loves this country’s people, and he wants to make sure that their voice is, is heard and not muted.”
Ivanka has yet to make a public comment about the media outlet’s revelations, but it feels like a serious departure from her deposition. Now, that’s an interesting twist to the story.
