North Carolina woman voted illegally for Trump but won't be charged for 'compassionate' reasons

Donald Trump has made a whole lot of noise about voter fraud in last year’s presidential election. The fact that he lost the popular vote continues to drive him absolutely nuts and, though he’s already been in the White House for almost 100 days, he continues to talk about how millions of people cast illegal votes. Well, he’s right. Not about the millions, but there is proof that some people voted illegally and most of them seem to have been for him. In North Carolina, for instance, a woman admitted that she cast an illegal vote for Trump in the presidential election, in order to fulfill her mother’s dying wish. The state prosecutor, a Republican, announced that she is not going to be charged for this crime. Big surprise, huh?

District Attorney David Learner, chief prosecutor for Catawba, Burke and Caldwell counties, announced his decision Wednesday not to pursue the case, which had been referred to him by the State Board of Elections.

Learner, a Republican, withheld the name of the voter but said she had cast the improper vote for Trump last November “out of sheer ignorance” of the law and while “grieving the loss of her mother.”
Anyone who has ever lost a parent can totally understand a child being overcome with grief. And people cope with death and dying in many different ways. But let’s not forget one small thing in this scenario—this is against the law. And can you imagine if this were a Clinton voter? Or if this woman were an immigrant? They’d have tried to put her away for life.

The voter said her 89-year-old mother was an enthusiastic Trump supporter who felt the Republican presidential candidate could “save our country.” The mother donated to Trump’s campaign and stayed glued to Fox News to watch his debates and follow the presidential election.

The mother also suffered from a serious heart condition. In late October, the daughter says she asked her mother to fill out an absentee voter request – just in case her health kept her from making it to the polls in November. The mother agreed, but added: “If anything happens to me, you have my power of attorney, and you be sure to vote for Donald Trump.”

The next day the mother suffered a massive stroke and died three days later, her daughter said, in a statement included in Learner’s release.

It was on November 3 that the woman took the power of attorney form to an early voting site and cast a vote for Trump using her mother’s name. The vote, it seems, didn’t have much impact on the outcome. Trump carried Catawba County by almost 70 percent of the vote. Still, and let’s keep coming back to this fact: this was illegal. But apparently, it doesn’t matter to District Attorney David Learner.

“It makes no difference who the vote was cast for,” he said in his statement. “This office consistently demonstrates compassion in dealing with first-time, non-violent offenders.

“She made a mistake out of sheer ignorance without any intent to defraud or commit a crime. She was grieving the loss of her mother and believed that the power of attorney allowed her to cast this vote.”
This demonstrates the sheer hypocrisy of Republicans. If this had been a Clinton voter and especially if this had made a difference in the election, there most certainly would have been no grace or compassion for this woman. Perhaps the Trump supporters should take some of the advice they were so famous for shouting on the campaign trail and “Lock her up!”

Mr Kobach has been a faithful supporter of Mr Trump’s election fraud claims. In April, he announced the first conviction of a non-citizen voting in the state of Kansas in the 2016 election.

However, the ACLU filed a freedom of information request to challenge the basis for the White House’s voter fraud claims.

ACLU’s Voting Rights Project director said: “President Trump is attempting to spread his own fake news about election integrity. Such claims have been widely debunked, but he is still trying to push his false reality on the American public.

“It is telling that the president’s choice to co-lead the commission is none other than Kris Kobach, one of the worst offenders of voter suppression in the nation today. If the Trump administration really cares about election integrity, it will divulge its supposed evidence before embarking on this commission boondoggle.”

The commission is expected to produce its first report sometime next year.

, about one for every 80 million people. By equivocating voting fraud and voter suppression, this commission will be a sinister attempt at making both seem like similar problems. They are not.

American state governments are racing to make voting more difficult for tens of millions of people – and the federal government is helping them. Voter suppression is as rampant as voter fraud is statistically nonexistent. Republicans’ efforts to undermine our democracy puts Russia to shame.

Trump asking Kobach to help him restore integrity in voting is like Hitler asking Goebbels to help put out the Reichstag fire. Kobach has whipped up hysteria about nonexistent voter fraud in Kansas and, in making people prove they are citizens in order to be able to vote, has effectively disenfranchised many legal voters.

trump and all remove all funding that is there to make sure the electronic voting machines are safe, from internal as well as russian hacking.

Department of homeland security has stopped all investigations to determine if Russia trolls influenced the election since trump took office. where europen countries have begun massive steps to stop russian trolling and russian fake news.

well well seems the guy in charge of the fake news vote numbers was fined recently by a judge on a voting matters case when he was sec of state of kansas.

IE for being a repugnat ie making “patently misleading representations” to the court about documents relevant to an ongoing voting rights case.


isn't that the core of a right winger. and when they do that they are perfectly qualified than to be in the whitehouse or working for trump?

THE BIG IDEA: The 10th Amendment is like the budget deficit. You only learn which Republicans genuinely care about it when their own party controls the federal government.
When Barack Obama was in charge, it was easy for GOP officials of all stripes to talk up states’ rights and decry out-of-control spending. Less than six months into President Trump’s tenure, much of that concern has fallen by the wayside. Each day brings fresh examples of rank hypocrisy.
But there are also principled conservative politicians who are proving that they follow the same moral compass whether Republicans are in power or in the wilderness.
The past week has brought a career-defining litmus test for secretaries of state in capitals across the country. By refusing to participate in the fishing expedition of a panel that was created by Trump to bolster his absurd claim that he “won the popular vote if you deduct the millions of people who voted illegally,” several Republicans in ruby-red states are demonstrating a politically courageous commitment to federalism.
Pushback from the right, more than any other factor, has now imperiled the nascent work of the “Presidential Advisory Commission on Election Integrity.”
“I denied the Obama Justice Department’s request, and I’m denying President Trump’s Commission’s request because they are both politically motivated,” Louisiana Secretary of State Tom Schedler (R) said in a statement. “The release of private information creates a tremendous breach of trust with voters who work hard to protect themselves against identity fraud. … This Commission needs to understand clearly (that) disclosure of such sensitive information is more likely to diminish voter participation rather than foster it. I have been fighting this kind of federal intrusion and overreach, and will continue to fight like hell for the people who trust me with the integrity of our election process.”
“It’s not sitting well with me,” said Wyoming Secretary of State Ed Murray (R). He told the Casper Star-Tribune that he will not turn over any voter data: “Elections are the responsibility of states under the Constitution. I’m wondering if this request could lead to some federal overreach. … I have not experienced any secretary of state who has expressed any concerns or worry about fraud or some type of nefarious activity occurring that jeopardizes their respective election process.”
Arizona Secretary of State Michele Reagan (R) called the commission a “hastily organized experiment.” “I share the concerns of many Arizonans that the Commission’s request could implicate serious privacy concerns,” she wrote in an open letter. “Centralizing sensitive voter registration information from every U.S. state is a potential target for nefarious actors who may be intent on further undermining our electoral process. … Without any explanation for how Arizona’s voter information would be safeguarded or what security protocols the Commission has put in place, I cannot in good conscience release Arizonans’ sensitive voter data for this hastily organized experiment.”
The bluntest statement of all came from Mississippi Secretary of State Delbert Hosemann (R). Setting the tone for his counterparts, he announced before the commission’s letter even arrived at his office that he wouldn’t comply. “They can go jump in the Gulf of Mexico,” he said of Trump’s panel. “Mississippi residents should celebrate Independence Day and our State’s right to protect the privacy of our citizens by conducting our own electoral processes.”
Other Republicans have also declined to share information but without such rhetorical flourishes, from Tennessee to South Dakota and Arkansas.
“The states that won’t provide all of their voter data grew to a group of at least 44 by Wednesday, including some, such as California and Virginia, that said they would provide nothing to the commission,” our Mark Berman and John Wagner tabulate. “Others said they are hindered by state laws governing what voter information can be made public but will provide what they can. … More than two dozen states said they will provide some of the requested information, according to interviews, public statements and media accounts. Others have not announced decisions or elaborated on what they plan to provide. … Partial responses from the states could lead to further problems, experts say, because the commission could ultimately assemble disparate — and incomplete — information in an effort to draw a national picture. The partial data could make it all largely worthless or misleading."

Vice President Pence is the chair of the panel and Kansas Secretary of State Kris Kobach (R), a former state GOP chairman who has long insisted without proof that there is widespread voter fraud, is the vice chair. Just last month, a federal judge fined Kobach $1,000 for making “patently misleading representations” to the court about documents relevant to an ongoing voting rights case. The White House blasted out a statement last night attacking stories about states refusing to hand over data to the panel as “more ‘fake news.” Responding to whip counts being kept by media outlets like CNN, the Associated Press and The Post, Kobach said: “At present, only 14 states and the District of Columbia have refused the Commission’s request for publicly available voter information.” That’s some lawyerly parsing if you read closely. “Despite media distortions and obstruction by a handful of state politicians,” Kobach added, “this bipartisan commission on election integrity will continue its work to gather the facts through public records requests to ensure the integrity of each American’s vote because the public has a right to know.”

What we know about Trump’s voter fraud commission
Southern states, of course, have historically had more antagonistic relationships with the central government. This dates to before the Civil War, but the Clarion-Ledger of Jackson explains the more recent context of the “go jump in the Gulf of Mexico” statement from Mississippi’s chief election officer: “In 2014, the Texas-based organization True the Vote and some Mississippi residents sued the state, Hosemann and the state Republican Party seeking birth dates of Mississippi voters after Chris McDaniel's primary loss to incumbent U.S. Sen. Thad Cochran. The state claimed voter's birth dates were private. The lawsuit claimed they fall under federal voting laws on disclosure. A specially appointed federal judge sided with the state and Hosemann.”
Likewise, Schedler fought a lawsuit by the Obama Justice Department that Louisiana was not aggressively enough trying to register voters who receive public benefits. “The President’s Commission has quickly politicized its work by asking states for an incredible amount of voter data that I have, time and time again, refused to release,” Schedler explained in his statement. “My response to the Commission is, you're not going to play politics with Louisiana’s voter data, and if you are, then you can purchase the limited public information available by law, to any candidate running for office. That’s it.”
He’s defended himself in a round of local interviews. “Tom Schedler’s being consistent in saying if it’s not good enough for Obama, it’s not good enough for Trump,” Schedler said during an appearance on a New Orleans talk radio station. “It’s a state’s rights issue …”
Whether you substantively agree with these guys is beside the point: They are demonstrating ideological consistency in an era of rampant tribalism, when many Republican politicians keep their fingers in the wind and contort their positions like pretzels to match whatever Sean Hannity is saying on Fox

Last night I was reading about Lyndon Johnson's response to Sheriff Clark's thuggery in Selma in "At Canaan Edge." There was little in Johnson's career to suggest that he might rise to meet the challenge of his age--as Trump has so obviously failed to do. But he did. You can see the start of his speech here:

His challenge to the south remains vital in these days. In his speech he offered an alternative to Federal intervention, "Open your polling places to all of your people. Allow men and women to register and vote whatever the color of their skin. Extend the rights of citizenship to every citizen of this land."

Republicans, once the party of Lincoln, have turned their back on this simple creed of justice. They have been engaged, for decades, in doing what they can to disenfranchise people of color for political advantage. Trump's election marks the success of those efforts.

It is my belief that any american is being denied due process when they are removed from voting without a conviction in court on a case by case basis. It is the burden of the government to prove you are not an america, Not the burden of an American to prove he is. Damages per person include damage to your family for economic prosperity and justice and there should be damages to all to be paid by the state that falsely accusing an american of not being one. Should result in each of those persons a million dollar settlement from that state.
