After reading this third party account I will write the details of this past Saturday as best I can. There was no fist fighting.

I get a mixed message that any truth is always filtered by emotions. To write down the truth of an incident between two people, and to take into account both sides of the perceived event, the truth will be reduced to the point of being meaningless and inconclusive facts. However I have always been fair with others while being responsibly active. I say this as the incident reports someone lost control of his kiting rig which then struck a car.

I had a mishap in the parking lot where we windsurf. One of my friends was being wreck less. He lunched his big kite in the parking lot on 24th Street. In doing so the airborne, then out of control kite, ended up dangerously in a free fall, and ended up slamming onto the top of my car.

Once he regained control of the kite in the public state, bayside parking lot, I was vigorously yelling at him as to his bad decision of thoughtlessly attempting to launch a kite upwind while endangering the property and more importantly the people downwind. I said to the kiter that a least he should have launched from a clear area, free of people and cars downwind of his launching site.

In doing so, I motioned with my right hand hitting the lines attached to his rig. The kite then flew into the water at the northern area of the old boat ramp.

This is where it got ugly. He went insane. His eyes were full of pure rage.

He proceeded to assaulted me with an obvious intent to harm my personal health. He could not control his anger at my response to his actions. He blamed me for losing control of his kite as it flew off into the bay. He came at me with fists a pumping. As I backed away from his threatening gestures he lunged at my chest, knocking me violently to the sharp broken sea shelled ground covering. I was bleeding from both my head and back caused by being shoved in a whiplashing effect onto my bare back.

Two of my friends attended to my bleeding cuts and said I should call the police, and I dialed 911. I was both emotionally and physically in a state of uneasy trauma.

I then stated to him that my intention was to call the police to report his launching a kite from the parking lot as a dangerous act. I never mentioned filing an assault charge which was't my intention. I was hurt and bleeding but luckily still conscience from hitting my head.

He was aware of the possible liability he was facing , and then told me his intent to charge me with assaulting him. I had grabbed his harness lines, and that was why he attacked me. He said that when I came into contact with those lines, the kite took off into the water, pulling him into a pier pilling. He indicated to a mild scrap below his knee which was the reasoning of his allegations against me. I never handled a kite,and the results that had just happened were unintentional. Other than that scrap, there was no damage to his rig. His only concern after that was to kite as soon as possible without any concern of anything. He had said he made a mistake in judgement when launching in the parking area.

The local Berkley Twp police arrived but did not have jurisdiction in the State Parking Lot. The officer left the scene saying I had to call the Park Ranger to report the incident.

At this point I was not going to report anything to anyone. It was then that someone pointed out that the kite had scratched the hood of my car. I decided I'd be in a better position, if it was on record that this man lost control of his kite, and then the kite had crashed down onto my car.

The rangers came and the report is now on file for me with a record to hold him true to his word that he will be responsible for any property damage incurred.

What a day! After all of this I did go windsurfing with a very troubled day for the sportsmanship of the sport behind me.

i saw this happen, i was there pulling them apart and telling both of them to shut up...

the kiter launched his kite in an over crowded parking lot. the kite was out of control as it worked its way up and did land on the sailors car. the kiter apologized and the kite went back up into the air. as it was flying in neutral 12ock position, the sailor came over and the argument ensued. It was so loud and heated that 3 of us, i was the first one there, walked over to separate them. they approached each other repeatedly through this agonizingly sophomoric ordeal.

I saw, with my own eyes, the sailor grab the kiters outboard lines (the ones on the kiters left, closest to the water), and pull them down.. (he reached over with an open palm, contacted the lines, closed his hand and twisted at his wrist) was this intentional? i dont know.. sure looked that way to me... the kite promptly crashed into the water. i could not believe my own eyes... the kiter totally flipped out, and moved towards the sailor aggressively as to hit him, (verbally saying it too iirc) the Kiter shoved him with both hands, both men (using the term loosely here) landed on the ground where they were rolling around fighting. we pulled them off one another.

repeatedly they continued to engage one another verbally. once they were on separate sides of the parking lot for like the 3rd or 4th time i had seen enough and went into the water.

i have no dog in this fight. my only vested interest is the launch itself, and trying to maintain the dignity of all sailors alike.

I live here, as do my friends, what occurred was so outrageously selfish and egregious...

Only if the guy who deliberately did something that stupid and dangerous got on his knees, apologized tearfully to everyone, packed up his kit, left, and never did anything that stupid and dangerous again is teaching him not to deliberately do anything that stupid and dangerous "selfish and egregious", IMO.

We've had several incidences not unlike that posted here recently, and too many perpetrators think their deliberate stupid and dangerous stunts are OK as long as they say "I'm sorry", "I didn't even see you", or "F U".

They are not OK, and some repeat offenders need to understand that. I still suspect the out of control kiter at Rowena discussed here last week was Benny/Benito. If so, he belongs in a prison hospital, not at a sailing site, because of his long history of attacking others, apologizing at length, and doing it again. And again. And again.

I was also there,but only saw the kiter first screaming then going after the windsurfer. The above post is accurate. Kites CAN NOT be launched in a busy parking lot,and adults fighting is absurd. This was not a good day for any type of sailing. If we keep acting like that it will be no wonder they close down a great spot.

Sounds like a few bad decisions where made by both involved. But what set the wheels in motion was the moronic act of launching a kite in a busy parking lot. If you want to do something dumb enough to kill yourself or get seriously hurt that's fine , but when you put others in harms way , NOT COOL..

I thought it was the discussion that was making me nausated, but maybe its the sight of man ass everytime I scroll down that's making me sick. Actually, its probably both.

Anyway, you two should consider yourselves lucky no one was seriously injured and that neither of you were "escorted" from the park by New Jeresy's finest. Pure stupidity.

Sorry about the pictures. I also have to agree that I should have immediately called the Island Park Rangers to report the dangerous attempt to fly a kite from the already mentioned packed parking lot. My car was fine as it landed first on my windsurfing board on top of the car. At that point I was upset to see a launch from the lot, not cool, so I yelled at the Lot Launcher. Got into his face with an attempt to let him know the danger of losing control of a kite above people, and me, btw. It's not that I wasn't personally mad at him for hitting the car. I'm not saying that, but the overall, could be danger, to everyone there was certainly more than I can imagine.

My bad. I seemed to have not cared that he is a big strong thirty something where as I'm sixty-four, skinny with only 140 lbs to back up my big mouth. I was stupid and lucky to walk away and thankful to those that held him back for a few seconds. I've never seen a face so ugly with rage.

After all of the crap posted about the launch's possible shut down, and people claiming to stop exactly this from happening. I shot my mouth off, while no one there attempted to approach Lot Launcher while getting reading to launch or after he lost control. People have said my balls are bigger than my brain, and they are probably right.
