right you are puppydog. but that doesn't exempt a developer from the requirements of the clean water act, the environmental species act, set backs from the high water mark of the columbia river or appeals to LUBa. And I believe all of these things help to keep the gorge "scenic".

Yeah. 10 years ago the boat basin was dormant. Nichols Boat works closed its doors sometime around 2000, or shortly thereafter. What do you think the boat basin was used for 10 years ago?

Phazle,

Do you get into the straps front or back foot first? Which foot do you step on the board with when waterstarting? I can't figure out yet if you are a good guy or a bad guy so answering these questions will help me get a handle on you.

It takes a law professor over 400 pages to try to convince me to embrace secret backroom deals? Something tells me the argument is a little bit convoluted. How about just using common sense?

Not trying to "convince," Mikephillips - but rather to "inform." Paper makes good arguments for both settlements and adjudication, and for both public and confidential proceedings.

If your preference is to employ what is most "common," sensible, then confidential settlement proceedings are in order. As the paper discusses, like it or not, .confidential proceedings are how matters such as these are settled in the overwhelmingly greatest number of circumstances.

We can argue about the system, but that is a topic we are not going to resolve here.

Personally, I would prefer settlement proceedings to be more transparent, but really to what end? Just to satisfy my curiosity? I'm more interested in the results, which I believe The Friends attorney stated he'd agree to make public once achieved.
