The Morning: Is shoplifting really surging?

Is the U.S. in the middle of a shoplifting wave? Target and other retail chains have warned of widespread theft. News outlets have amplified the story. On social media, people have posted videos of thieves looting stores.

But the increase in shoplifting appears to be limited to a few cities, rather than being truly national. In most of the country, retail theft has been lower this year than it was a few years ago, according to police data. There are some exceptions, particularly New York City, where shoplifting has spiked. But outside New York, shoplifting incidents in major cities have fallen 7 percent since 2019, before the Covid pandemic.

Why has the issue nonetheless received so much attention? Today’s newsletter tries to answer that question while taking a deeper look at recent shoplifting trends.

The data
The various sources of crime data — from government agencies and private groups — tell a consistent story. Retail theft has not spiked nationwide in the past several years. If anything, it appears less common in most of the country than it was before the pandemic.

The most up-to-date source is the shoplifting report published this month by the Council on Criminal Justice, which uses police data through the first half of 2023. The other sources go through only 2022.

The council tracks 24 major U.S. cities. Overall, shoplifting incidents were 16 percent higher in the first half of 2023 than the first half of 2019. When New York City is excluded, however, reported shoplifting incidents fell over the same time period. Out of the 24 cities, 17 reported decreases in shoplifting.

The shoplifting problem “is being talked about as if it’s much more widespread than it probably is,” said Sonia Lapinsky, a retail expert at the consulting firm AlixPartners.

Other data also indicates that shoplifting is not up in most cities since 2019. Retailers’ preferred measure, called shrink, tracks lost inventory, including from theft. Average annual shrink made up 1.57 percent of retail sales in 2022, up slightly from 2021 (1.44 percent) but down compared with 2019 (1.62 percent). The F.B.I. and the Bureau of Justice Statistics also found that theft and property crime ticked up in 2022 but remained below pre-Covid levels.

The notion that the U.S. is enduring a period of higher crime in some areas is not wrong. Car thefts are up by more than 100 percent since 2019. Murders are on track to be 10 percent higher this year than they were in 2019.

Many major downtown areas have also become emptier and more chaotic since the pandemic, which may explain why drugstores and other retailers are more often locking up items even if shoplifting isn’t much more common than in the past.

The noise
There seem to be several reasons that shoplifting has received so much attention lately:

Events in New York tend to receive outsize scrutiny. It is the country’s biggest city, a big retail market and the headquarters for much of the national media. Another city where property crime has risen is Washington, D.C., where many journalists, as well as politicians, also live.
Videos of extreme but rare crimes can go viral today. On social media, people post videos of looting flash mobs or thieves ramming cars into stores. “There are millions of property crimes a year,” said Jeff Asher of the research firm AH Datalytics. As a result, people can always find outlandish anecdotes, even if crime is down.
Conservative media has promoted these videos as evidence of disorder in liberal cities and under President Biden.
Retailers have an interest in spreading the shoplifting narrative because it can suggest that disappointing profits are beyond their control.
Inflation may play a role, too. Even if retail theft is not up, retailers might care more about it now. After all, higher prices have eaten into their profit margins by increasing the underlying costs of doing business. That makes reducing theft more important.
The rise in murder, car theft and some other crimes makes shoplifting seem like part of a larger story even if it isn’t in most cities.
Whatever the full explanation, the current focus on shoplifting is part of a broader trend: The public often overestimates crime. Over the past two decades, most Americans have said that crime is rising, according to Gallup’s surveys. In reality, crime rates have generally plummeted since the 1990s.

Stefanik said, "They are all witch hunts against Donald Trump and the reason is he is pulling ahead of Joe Biden."

She seemed to be irritated by the question and added, "The media is so biased. This is just another example of the media being out of touch…"

Hillyard added, "It's not me. It's not the media, it's a jury that found…"

Stefanik added, "The media is so out of touch with the American people. Like 2016, you are going to see the American people speak out loudly and clearly with their vote."

The Trump campaign did not immediately respond to a request for comment.

The court will hear two cases, Moody v. Netchoice LLC and Netchoice LLC v. Paxton, in which Netchoice—a lobbying group representing social media companies—is challenging social media laws in Florida and Texas, respectively.

The Florida law, which an appeals court struck down as unconstitutional, fines social media companies up to $250,000 per day if they “willfully deplatform” political candidates by banning them or suspending them for more than two weeks, and prohibits banning “journalistic enterprises” for their content.

Texas’ law, which a different appeals court upheld, bans social media platforms from censoring users based on their “viewpoints,” requiring companies to disclose how they moderate content, explain to users why their content was removed and establish a complaint process for users to protest either content on the site or content moderation decisions.

The laws reflect longstanding concerns by conservatives that social media platforms purportedly discriminate against them, though research has found there is no evidence to support those claims.

Netchoice argues the laws impermissibly infringe on the companies’ First Amendment rights to free speech and they should be able to moderate content on their platforms as they see fit, likening the companies to other industries like newspapers that are allowed to pick and choose what content they publish.

Neither law is currently in effect pending the court’s ruling, as the appeals court blocked the Florida law and Supreme Court ruled 5-4 in May 2022 to temporarily block the Texas law after it was upheld by the appeals court.

What To Watch For
The court will hear oral arguments Monday and issue its decision likely in several months, sometime before the court’s term wraps up in June.

What We Don’t Know
What impacts the court’s ruling could have. Critics of the social media laws have argued that a ruling upholding the policies could lead to “absurd results” as companies lose the power to moderate content as they choose. The Electronic Frontier Foundation and other free-speech advocates wrote in a brief to the court that a ruling in Florida and Texas’ favor could not only lead to harmful information running rampant in the absence of content moderation, but also affect sites that specialize in a certain subject matter, “destroy” online communities that are reliant on curation and “handicap” companies’ efforts to ensure information is accurate. On the other hand, advocates of the laws being upheld argue that a broad ruling in favor of the companies would also yield harmful results, with progressive legal scholar Zephyr Teachout writing in the Atlantic that such a ruling “could jeopardize all kinds of efforts to regulate digital platforms” and find “the government cannot prohibit dominant platforms from unfairly discriminating against certain users.”


Experts noted to Politico that billionaire Elon Musk’s takeover of Twitter, whose name has since changed to X, and the rise of right-wing social platforms has made the Florida and Texas laws less necessary in the years since they were first passed in 2021. “We’re in a different place now,” tech consultant Nu Wexler told the publication. “You could argue that Texas and Florida laws are no longer really necessary because conservatives have more options now for social platforms.”

Surprising Fact
While the cases being heard Monday center on laws passed by Republicans—and the Biden administration has opposed the policies in court—support for the two sides in the case hasn’t strictly fallen along ideological lines. Teachout and other liberal legal experts filed a brief with the court arguing in favor of the laws being upheld, writing that while the Florida and Texas laws “in certain ways do not represent the policy choices that [the scholars] would make,” striking them down “would risk granting a broad and unjustified immunity to social media platforms from nearly any regulation in the public interest.” The U.S. Chamber of Commerce, which has typically sided with Republican interests, also argued against the laws, writing in a court brief that upholding the laws could pose a “broader threat to online commerce” and “would give government an unprecedented degree of authority over expression in modern commerce that threatens core First Amendment values.”

Tangent
The Supreme Court will also hear another social media case next month with Murthy v. Missouri, which challenges the Biden administration’s pressuring of social media companies to block misinformation about Covid-19, Hunter Biden’s laptop and the 2020 election. The case aims to bar the federal government from contacting social media companies about disputed information.

Key Background
Conservatives have long rallied against social media companies for what they’ve viewed as a purported “bias” against them, taking issue as high-profile Republicans have been kicked off social media platforms over hate speech or misinformation. (Many have since been reinstated on X following Musk’s takeover of the company.) That outcry escalated after former President Donald Trump was removed from social platforms after the Jan. 6, 2021, riot, and Trump has been among the loudest critics of the companies, forming his own social network Truth Social in response to the bannings and filing lawsuits against Facebook, Twitter and other networks in 2021 for allegedly infringing on his and other Republicans’ First Amendment rights. The ex-president has filed a brief arguing for the Texas and Florida laws to be upheld, writing social media companies “act like airlines carrying passengers, telegraph companies transmitting messages, or railroads carrying freight” and thus can’t discriminate about content on the platforms. The Supreme Court has previously been largely deferential to social media networks in other recent cases justices have taken up, including striking down a North Carolina law that barred sex offenders from social media and ruling in Google and Twitter’s favor in cases last term that sought to hold them liable for giving terrorist groups a platform.

Churches are barred from engaging in certain political activities to maintain their status as tax-exempt nonprofits. While pastors are allowed to discuss political issues at the pulpit, churches may not endorse or donate to specific political candidates. Pastors, however, may endorse political candidates as a citizen.

Newsweek reached out to Hibbs for comment via email.

The organization Freedom From Religion Foundation wrote in a post to X (formerly Twitter) they plan to ask the Internal Revenue Service (IRS) to "ensure that Pastor Hibbs' church no longer receives the benefits of 501(c)(3) status and that donations made to his church are no longer treated as tax deductible."

Video of Hibbs' remarks, first posted to X by Right Wing Watch, sparked some criticism on social media, with some arguing that churches that engage in politics should be taxed. One X user named Ramon Caudle wrote, "Behind the pulpit or not, he's still addressing his congregation in a political manner. Take away his tax exemption!"

Garvey, a former baseball star, has earned support from many Republicans to take on Democrats in the Senate race in the state, which is known for its embrace of more progressive policies. However, Garvey may face a key hurdle in making it to the November general election.

California is among the few states that use the "jungle primary" system, in which all candidates, regardless of their political party, will run on the same ballot during the primary election in March. The two candidates who receive the most votes will then go on to the general election, creating a challenge for Republicans as the state's voters select two Democrats to run in November.

Representative Adam Schiff is the favorite to advance to the general election, but polls show that both Garvey and Representative Katie Porter vying for the second spot with no clear leader to join Schiff. This means Republican candidates could face being locked out of the election.

Regardless of whether Garvey makes it to the general, the election is not viewed as competitive as California remains one of the most Democratic states in the country. In the 2020 presidential election, the state gave President Joe Biden more than 63 percent of the vote, while only about 34 percent of Californians backed Trump.

The senator has had a rough go of late. Last week, he praised an Alabama Supreme Court decision stating that embryos are people, which prompted several clinics that offer in vitro fertilization to pause the service. At the same time, he said, “We need to have more kids.”

When a reporter noted the court’s ruling would likely mean fewer kids, he replied, “That’s a hard one, it really is.”

One deepfake, created by Mark Kaye and his team at a conservative radio show in Florida, shows Mr Trump smiling with his arms around a group of black women at a party.

It was shared on Facebook, where Mr Kaye has more than one million followers and, from the comments posted below, it was apparent that some users believed the AI-generated image was real.

“I’m not a photojournalist,” Mr Kaye told the BBC. “I’m not out there taking pictures of what’s really happening. I’m a storyteller.”

He had posted an article about black voters supporting Mr Trump and illustrated it with the AI image.

“I’m not claiming it is accurate,” added Mr Kaye. “I’m not saying, ‘Hey, look, Donald Trump was at this party with all of these African American voters. Look how much they love him!’

“If anybody’s voting one way or another because of one photo they see on a Facebook page, that’s a problem with that person, not with the post itself.”

Another deepfake seen by the BBC shows Mr Trump posing with a group of young black men on a doorstep

The BBC claimed the person behind the account, called Shaggy, is a committed Trump supporter living in Michigan.

His post has had over 1.3 million views, according to X (formerly Twitter). Some users called it out as a fake but others seemed to believe the image was real.


Mr Trump’s campaign is hoping to increase support from black voters, who were important to Joe Biden’s victory in 2020.

A recent New York Times and Sienna College poll found that in six key swing states 71 per cent of black voters would back Mr Biden in 2024, lower than the 92 per cent nationally that helped him four years ago.
