So, it seems to me that even if the Port of Hood River, in the name of the public, bought the submerged and submersible land in the boat basin and sold it to a private developer, the waters, which enter and exit from the Columbia River, may still be subject to the Oregon State Law concerning the Public Trust Doctrine. Recreational navigation by boat would include canoes, kayaks, sailboats and paddleboards. (today there were 7 paddleboarders and two kayakers in the boat basin when I last looked. Yesterday there was a sailboat navigating around in the boat basin) So the question remains, for me at least, can a developer legally build a cable park in the boat basin and restrict the the rights of the public to the provisions of the Public Use Doctrine??

The proposed area of the cable park doesn't go all the way to the beach where most people launch their sail-boats, paddle-boards, kayaks, and whatever, so while it would certainly limit the area they could go around during use, it isn't really limiting water access to them. Also considering there's the event site, marina, waterfront park, and the hook paddleboarders and kayakers aren't really limited to water access to begin with.

The Public Trust Doctrine is not about whether or not there is a place for people to launch their watercraft. It's about the larger question of whether or not a private land owner (in this case a cable park) can carve out public use waterways for themseves and prevent others from navigating (float, paddle, sail) through it.

I think the cable park sounds like a fun idea. As for the hotel, I don't mind that much either as you said it won't affect the winds much. I did a ton of windsurfing in front of a strip of Marthas Vineyard hotels and the winds were great so this shouldn't affect that. I hope it all goes through. Keep us posted.

i would think bingen would try to out do the hood river community for the hotel and cable combo. the eyesore of the lumber operation is already in place over there. they certainly could use some jobs as well. wouldn't it be less obtrusive too? scenic authorities may have the final say, anyway. might as well put such an operation over in that area anyway. lots of capacity, infrastructure, to boot.

the pain in the adze factor of loading too many things into one area (traffic concerns) is really counter productive in the long run. oh, lots of folks forget about that? look at the eyesores of the east coast, miami beach, pompano beach, panama city, myrtle beach, daytona, etc. those areas have places that truly suck to get through, and are avoided by lots.

What HR really needs is a real rec center with standing wave, rock wall, hell, it could even use an ice rink...

I advocated for an indoor facility. A cable park Super Dome in HR would be ideal. Never heard back from them, I can take a hint.

My new Brainstorm is the hot water station. One of those instant warm/hot water deals with a hose that you can stick in your suit. You add 8 months to the cable season with this concraption. I wasn't really into any of it, but, the situation being what it is,, maybe with a hot water hose, they could get this thing going??

If it was indoors, they could add fans for windsurfing. How could anyone object to that?? I'm IN!

Please join in to fight the legal precedents that will be established if the Nichols basin, a public water way, is privatized resulting in the banishment of swimmer, fisherman, SUP'ers, kayakers, bird watchers, canoeist, and any other user how enjoys the free and open use of our publicly held water ways.

And my love for the Oregon Coast continues to grow. Love me some 53 degree water.
