even if fake plant by the russians should be investigated to the fullest till it is determined it is not a russian counter media propaganda to harm liberals.

Considering it is a fact that a female filed a court case with other witnesses sworn testimony trump raped her when she was 13 years old. There should be no limits into such investigations considering trumps longest and closest best friend was Epstein.

The judge, Verna Saunders, denied Trump's request to stay the defamation lawsuit brought by E. Jean Carroll.

Saunders cited the recent Supreme Court decision that allowed Manhattan DA Cy Vance to proceed with a subpoena for Trump's tax returns, a ruling that rejected the president's claim of absolute immunity from any aspect of criminal procedure while in office.

"This court construes the holding in Vance applicable to all state court proceedings in which a sitting President is involved, including those involving his or her unofficial/personal conduct," Saunders wrote.

The White House declined to comment on this latest update.

Carroll, who served as an advice columnist at Elle magazine for over 20 years, has accused Trump of raping her in the 1990s. He has denied ever meeting her.

She sued him for defamation, arguing he damaged her reputation and career – she lost her job at Elle – by denying her story and claiming she took money from political opponents to fabricate it.

"We are very gratified that Judge Saunders, recognizing the clear holding of the Supreme Court in Vance, has rejected President Trump's assertion of absolute immunity and has denied his motion to stay E. Jean Carroll's case," her attorney, Roberta Kaplan said.

Lawyers for Trump didn't immediately respond to a request for comment on Saunders's ruling.

Carroll, an advice columnist who for years wrote for Elle Magazine, alleged in a lawsuit filed last fall that Trump sexually assaulted her in a dressing room at luxury Manhattan department store Bergdorf Goodman in the 1990s. Trump has denied the allegation, calling it "totally false" and saying he "never met this person in my life."

In January, attorneys for Carroll served an attorney for Trump with papers requesting a sample of his DNA to compare with male genetic material found on the black Donna Karan dress Carroll says she wore during the alleged encounter at Bergdorf's.
That request was put on hold in the wake of an order from the judge that halted discovery requests until Trump's motion to stay the case has been decided.

Trump's lawyers had argued to the court that the Carroll case should be delayed until a state appeals court rules in another, similar case brought by former "Apprentice" contestant Summer Zervos on the question of whether the state courts have jurisdiction over him while he occupies the White House.

But lawyers for Carroll said Trump shouldn't be allowed to delay the case in light of the fact that he has both continued to handle other cases as a defendant while serving as President and has also continued to file lawsuits. They submitted further arguments in the wake of the Vance ruling, arguing that it should permit their case to move forward.

Carroll published her allegation in June 2019 in New York magazine, writing that Trump, then a private businessman, sexually assaulted her in a department store dressing room.

Trump denied the allegations, saying "she's not my type."

A White House spokesman was not immediately able to comment. A spokeswoman for the DOJ declined to comment.

Roberta Kaplan, Carroll's attorney, hailed the decision.

"The simple truth is that President Trump defamed our client because she was brave enough to reveal that he had sexually assaulted her, and that brutal, personal attack cannot be attributed to the Office of the President," Roberta Kaplan said. "We look forward to moving forward with E. Jean Carroll's defamation case against Donald Trump in his personal capacity in federal court."

The DOJ had successfully moved the case from New York state court to federal court earlier this year. It later argued that Trump is covered by the Federal Tort Claims Act, a law that allows certain suits to be brought against government employees acting in their official capacity.

But the law does not allow for defamation cases against government officials, meaning that if the judge had sided with the DOJ over the issue, Carroll's suit would likely have been thrown out.

The DOJ argued that Trump was acting in official capacity when he addressed Carroll's allegations, partly because refuting her claims would help him better carry out his duties. But the judge on Tuesday ruled that theory would be far too expansive if it were adopted by the courts.

"While the government's position is not entirely without merit, it goes much too far," the judge wrote. "Accepting it would mean that a president is free [to] defame anyone who criticizes his conduct or impugns his character-without adverse consequences to that president and no matter what injury he inflicts on the person defamed."

ahh shows they know that the information can and better be released by Biden.

How many years did the right wing have Hillary investigations after she was out of office was it about 20 investigations by the house and senate. And not one fact was uncovered that caused a grand jury to indict. And she testified under oath for what 10 or so hours.

These dems better have some guts and go for the juggler on Trump and his criminals. Begin by releasing all the falsly classified documents. Remember Supreme court illigetimate Justice Kavanaugh when investigation Clinton with his pedophile lover Kenny boy Starr released the grand jury and all investigative materials to the house.
