George Zimmerman haters throughout the media have carped and whined about the fact that there werenít any African-Americans on the jury despite the law requiring the accused NOT the victim be judged by his peers.

On CNN Newsroom Tuesday, it was revealed that a potential black juror had been struck by the prosecution for committing the crime of being a Fox News watcher (video follows with transcript and commentary):


CAROL COSTELLO, HOST: So Mark, do Trayvon Martin's parents you think, I mean, when they look at the jury makeup and they look at the decision that jury came to, do they say why didn't we have an African-American on the jury? Why did we have six white women?

MARK NEJAME, CNN LEGAL ANALYST: And that's what we were saying from the beginning. You know, sometimes I've been criticized by some who don't understand that a legal opinion is very different than a personal, a social, or a philosophical opinion. When you look at the composition of Seminole County, it's eleven percent African-American. And when you look at Sanford, itís 30 percent African-American. So when you subtract Sanford from the overall Seminole County, you have, you know, a very, very small minority, specifically African-American representation within Seminole County. So when in fact you condense that down to a jury, the odds of getting an African-American on the jury are very slim when you're in Seminole County.

COSTELLO: Although if I remember correctly one of the prosecutors struck a black, a potential black juror from the jury.

MICHAEL SKOLNICK, POLITICAL DIRECTOR TO RUSSELL SIMMONS, CO-PRESIDENT GLOBALGRIND.COM: Yeah, he was also, I was just, he was also a Fox News watcher. So that was, you know, problematic for the prosecution.

In case you were wondering, Skolnick is not a Zimmerman supporter or a conservative.

Besides being hip-hop mogul Russell Simmons' political director and the co-president of GlobalGrind.com, he's also on the board of directors of the Trayvon Martin Foundation.

That said, it appears black jurors were only going to be acceptable to the prosecution if they were liberals getting their "news" from Zimmerman-hating media outlets.

Martin supporters should keep that in mind as they complain about the makeup of the jury.

No fooling? The prosecutors struck down a black juror because he had a different viewpoint than theirs? They must be racists.

And of course now, Holder is spewing venom and whites and Hispanics are being beaten on the streets of our cities because of their race. Let's see how quickly Holder charges them with a hate crime...... Wink

What could be worse than that?

Stevie Wonder is going to boycott Fla. because of the shooting and the "stand your ground" law, so be it.

But maybe he should consider Chicago as well, they don't have that "stand your ground" law, and they have the strictest gun laws in the country, so how's that working out? They have the highest black on black death rate in the country, children included.

More is revealed about the commentor than the case for most of these comments on the Zimmerman verdict. The tantrums miss the point, and the evidence. A few observations:

1. Zimmerman was in fact cut and showed having been in a fight, while Trayvon Martin was largely unhurt except with a small abrasion until he was shot. With sufficient evidence of a mutual combatant fight, the laws about self defense and reasonable doubt pretty much guaranteed that a second degree murder charge couldn't be sustained. I have no problem with this part of the jury's decision.

2. Zimmerman had, as a neighborhood watch guy, reason to be wary when he saw someone he didn't know in a locked gate neighborhood that had some history of burglaries. It is not necessarily a sign of racial animus, and calling the police and paying some attention to Martin was not unreasonable. What may have been unreasonable was to approach Martin, or to verbally accost him. Nobody whose motives can be relied on knows how the fight started, but there is sufficient evidence that Martin noticed Zimmerman and thought he was stalking him.

3. Zimmerman was older and heavier than Martin, although not by 100 pounds as was once reported, and had a history of violence, being charged with battery--on a police officer--in 2005. Evidence that Martin had smoked marijuana sometime in the past few days is not evidence of violence.

4. Zimmerman will have to live with having killed a kid, and the hatred that his action engenders in some, for the rest of his life. It was a tragedy that stemmed from at least bad judgement, and perhaps hotheadedness, in his eagerness to get the thieves and not rely on the police. With some juries, that might have resulted in a manslaughter conviction.

5. The DOJ has to complete their investigation, but I would be astonished if they file a civil rights case based on what I see of the evidence. The commentary here attacking them for doing what they are required to do is evidence of bias--from those who consistently claim that they are free of bias (but quickly leap to conclusions and post insensitive and charged comments.)

6. Most people have missed the true tragedy--that the aggressive, stand your ground posture, gun packing culture encouraged by the NRA has created a true tragedy--for the Zimmerman's as well as the Martin's. Nobody will ever truly recover from this, and it could readily have been avoided if Zimmerman had stayed in his truck--as recommended by the dispatcher--and waited for the police--or called them again. Suspicion that there might be a burglar in the neighborhood, entirely reasonable under the facts, does not suggest that an escalation to force, and possibly deadly force, is reasonable.

7. The same set of facts would argue for an acquittal if Martin had been packing a gun and believed that he saw Zimmerman brandishing his. But I doubt that a Florida jury would have reached such a verdict.

There is substantial evidence that Martin was beating the hell out of Zimmerman prior to being shot. There is also evidence that Martin was quick to brawl. He had a history of drugs and violence. Lastly, "battery on a peace officer" is rarely prosecuted because cops claim that anytime a speeder refuses to sign the ticket.

Stand your ground law is a surprising over reaction to the fear that Obama is going to take our guns away. Very stupid law. If you are in fear for your life, you should back off, but use any weapon at hand to protect yourself.
